RESOLUTION # 35 -S -
A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK
OF THE CITY OF BATESVILLE, ARKANSAS, TO EXECUTE AN AGREEMENT WITU
THE UNITED
STATES OF AMERICA FOR EMERGENCY STREAMBANK PROTECTION .
ON WHITE RIVER AND EXECUTING A TEMPORARY CONSTRUCTION RIGHT-OF-
WAY IN CONNECTION THEREWITH: AND FOR OTHER PURPOSES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS AS FOLLOWS :
Section . 1 : That the City Council of the City of Batesville,
Arkansas, hereby authorizes and directs the Mayor and City Clerk
of the City of Batesville, Arkansas to execute an agreement with
the United States of America for emergency streambank protection
on the White River; that a copy of said agreement is attached
hereto, marked EXHIBIT "A" and made a part hereof as though fully
set out herein word for word.
Section 2 : That the mayor is further authorized and directed to
execute a temporary construction right-of-way permit to the United
States of America in association with said agreement for emergency
streambank protection on the White River; that a copy of said
temporary construction right-of-way permit is attached hereto,
marked EXHIBIT "B" and made a part hereof as though fully set out'
herein word for word.
