A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY
CLERK OF THE CITY OF BATESVILLE, ARKANSAS, TO EXECUTE A CERTIFIED
LOCAL GOVERNMENT PROGRAM FY85 GRANT AGREEMENT WITH THE ARKANSAS
HISTORIC PRESERVATION PROGRAM; AND FOR OTHER PURPOSES.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS AS FOLLOWS:
SECTION 1 : That the Mayor and City Clerk of the City of Batesville,
Arkansas, are hereby authorized and directed to execute a certain
Certified Local Government Program FY85 Grant Agreement and to
perform those duties connected therewith, a copy of said agree-
ment being attached hereto, marked EXHIBIT "A" and made a part
hereof as though fully set out herein word for word.
SECTION 2 : That the Mayor and City Clerk are further authorized
and directed to other such acts as are necessary to perform the
obligations and duties of the City of Batesville pursuant to that
agreement.

CERTIFIED LOCAL GOVERNMENT PROGRAM
• FY85 GRANT AGREEMENT
This agreement is entered into between the City of Batesvile, Arkansas
hereinafter referred to as the City and the Arkansas Histor c Preservation
Program, hereinafter referred to as AHPP on the 29th day of January, 1986.
The AHPP agrees to provide a grant in the amount of $4810. 0 to the City to
be matched by a sum in the amount of $5655. 00 provided by the City for the
purpose of fulfilling requirements to qualify as a Certifie Local Government,
as outlined in "Arkansas Certified Local Government Procedures. " The attached
work schedule is incorporated into this agreement.
THIS GRANT IS FOR THE ACCOMPLISHMENT OF THE PURPOSE, OBJECTIVE AND SCOPE OF
WORK HEREIN DEFINED.
I. SCOPE-OF-WORK
Initiate a process to qualify Batesville to participate in the Certi-
fied Local Government Program.
1. Establish a historic district commission in accordance with
Ark. Stat. Ann. 19-5009 et seq. and the Certified Local Govern-
ment Procedure for Arkansas ( "Procedures")
• 2. The Commission will develop and implement a process to qualify
Batesville as a Certified Local Government.
3. Prepare a draft local ordinance designating a historic dis-
trict pursuant to Ark. Stat. Ann. 19-5009 and the "Procedures".
4. Design and produce a photo-display and brochure which identify
and promote historic downtown Batesville.
5. Submit a report to the AHPP on certified local government
status.
II. PERSONNEL
There will be a Project Coordinator whose full or part time responsi-
bility it will be to coordinate all activities outlined in this grant
agreement. It will also be the responsibility of the Project Coordi-
nator to keep the AHPP informed of the grant project status by sub-
mitting a monthly activity report on the first day of each month of
the grant period.
The Project Coordinator must possess demonstrableorganizational/
managerial skills and experience in research/writing in the field of
history. Experience in working with the public and photographic
skills are desirable.

IV. SCHEDULE_OF_PAIMENTS
• One-half of the grant amount $2405. 00 shall be p id to the grantee
upon commencement of the project and a request for payment stating
this above.
Final payment of the grant amount $2405. 00 shall be made to the
grantee following completion of grant requirements, submission of all
products generated by this project and a request for payment.
V. AHPP_FESPONSIBILITIES
The AHPP staff will make periodic site visits to the project area and
to review practices and products. The AHPP reserves the right to
enforce the procedures as outlined in this contract. The AHPP agrees
to make available advice and counsel necessary to accomplish the
objectives and to render compensation upon invoice within a reason-
able time frame.
VI. COMPLIANCE
All policies and procedures of the Department of Interior, the
National Park Service as well as federal regulatio s governing expen-
ditures of all Federal Funds must be followed by tie AHPP and all
subgrant recipients. All grant projects will be administered by the
AHPP in accordance with the Historic Preservation rant-in-Aid and
• Procedures Manual. Separate financial records for each project will
be maintained by the Arkansas Historic Preservation Program following
Office of Management and Budget Guidelines. The grantee must main-
tain efficient and effective accountability and control of all funds
received and expended under a subgrant from the AHPP.
Management And Budget Guidelines
The grantee must assure and certify that he will comply with the regulations,
policies, guidelines and requirements as they relate to the application,
acceptance and use of federal funds for this federally-assisted project, as
contained in attachment G of OMB circular, A-102. Also the grantee assures and
certifies that:
1. the City will comply with and administer the project in conformance
with the Civil Rights Act of 1964 ( Public Law 88-352) , as amended; as
well as 43 CFR 17 and Part 506 of the Department Manual issued by the
Department of the Interior; and Section 504 of the Rehabilitation Act
of 1973, as amended, which prohibits discrimination against the
handicapped. Title VI of the Civil Rights Act of 1364 stated that no
person will, on the grounds of race, color, or nati nal origin, be
excluded from participation in, be denied the benefits of, or be
otherwise subjected to discrimination under any pro ram or activity
for which the applicant received Federal financial ssistance and
will immediately take any measures necessary to effectuate this
agreement;
• 2. in all hiring or employment made possible by or resulting from grant
awards, the City ( 1) will not discriminate against ny employee or
applicant from employment because of race, color, r ligion, sex, age,
or national origin, and ( 2) will take affirmative action to ensure
that applicants are employed, and that employees are treated during
employment, without regard to their race, color, re igion, sex, age,
or national origin. This requirement applies to, bit is not limited
to, the following: employment promotion, demotion, r transfer;
recruitment or other recruitment advertising; layofl or termination;
rates of pay or other forms of compensation; and seLection for
training, including apprenticeship. The grantee an,J his subgrantees

4. the City will comply with all requirements imposed by the Federal
• sponsoring agency concerning special requirements of law, program
requirements, and other administrative requirements
5. the City will comply with the minimum wage and maximum hours
provisions of the Federal Fair Labor Standards Act, as they apply to
hospital and educational institution employees of state and local
governments.
6. Upon completion of the project, the Secretary of the Interior, the
Comptroller General of the United States, the AHPP, and/or any of
their duly authorized representatives shall have access for the
purpose of financial or programmatic audit and examination any books,
documents, papers and records of the grantee that are pertinent to
the grant at all reasonable times during the period of retention
provided in OMB Circular A102, attachment C, for at least three ( 3)
years or until all claims or audit findings have been resolved.
7. Lobbying with appropriated funds. Historic Preservation Fund grants
must conform to provisions of 18 USC 1913: "No part of the money
appropriated by any enactment of Congress shall, in the absence of
express authorization by Congress be used directly Dr indirectly to
pay for any personal services, advertisement, teleg am, telephone,
letter, printed or written matter, or other device, intended or
designed to influence in any manner a Member of Con ress, to favor or
oppose, by vote or otherwise, any legislation or ap ropriation by
• Congress, whether before or after the introduction f any bill or
resolution proposing such legislation or appropriation by Congress,
whether before or after the introduction of any bil or resolution
proposing such legislation or appropriation; by thi shall not
prevent officers or employees of the United States or its Department
or agencies from communicating to Members of Congress on the request
of any Member or to Congress, through the proper official channels,
requests for legislation or appropriations which they deem necessary
for the efficient conduct of the public business. " Thus, costs
associated with activities to influence legislation pending before
the Congress, commonly referred to as "lobbying, " are unallowable as
charges to NPS assisted grants.
VII. PUBLICATIONS_AND_PUBLIC_INFORMATION
An acknowledgment of National Park Service and Arka sas Historic
Preservation Program support must be made in connec ion with the
publication of any material based on, or developed nder, any activi-
ty supported by Historic Preservation Fund grant fu ds. This acknow-
ledgment shall be in the form of a statement as fol ows:
The activity which is the subject of this ( type of ublication) has
been financed ( in part/entirely) with federal funds from the National
Park Service, Department of the Interior, administe ed through the
Arkansas Historic Preservation Program. However, tie contents and
opinions do not necessarily reflect the views or po icies of the
• Department of the Interior, nor does the mention of trade names or
commercial products constitute endorsement or recom endation by the
Department of the Interior or the Arkansas Historic Preservation
Program.
Press releases, publications, and other public dissemination of in-
formation by a grantee made possible by a grant sha 1 acknowledge
Department of the Interior, National Park Service and Arkansas His-
toric Preservation Program grant support. A minimup of eight copies
of any publication will be furnished by the grantee to the Arkansas
Historic Preservation Program. The Arkansas Histor c Preservation
Program will transmit three copies to the Departmen of the Interior

VIII. LIMITATION_OF_LIABILITY
• The AHPP assumes no responsibility with respect to accidents, illness
or claims arising out of any work performed under E subgrant suppor-
ted project. The subgrantee is expected to take n cessary steps to
insure itself and its personnel and students and tc comply with the
applicable local, State, or Federal safety .standar s, including those
issued pursuant to the National Occupational Safet and Health Act of
1970 ( see 20 CFR 1910) .
IX. AMENDMENTS
This agreement may be amended upon written request and approval by
both parties.
X. TIME_FRAME_OF_AGREEMENT
This agreement will begin on March 1, 1986 and shall extend until
August 29, 1986.

The City of Batesville is aware that this grant is contingent upon
approval of the AHPP and the availability of funds; and agrees that
no work will begin on the project until written approval from the
AHPP is received.
