ORDINANCE NO. 96-9-1 AN ORDINANCE BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AN ORDINANCE ACCEPTING THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF BATESVILLE, ARKANSAS AND MAKING SAME A PART OF THE CITY OF BATESVILLE, ARKANSAS, AND ASSIGNING SAME TO WARDS. i WHEREAS, Petition was filed with the Court Clerk of Independence County, Arkansas, by the majority of the real estate owners of the hereinafter described territory praying that said territory be annexed to, and made a part of the City of Batesville, Arkansas; and, WHEREAS, on the 16th day of August, 1996, the County Court of Independence County, Arkansas, found that the petition was signed by a majority of the real estate owners in said territory; that said territory was contiguous and adjoining the present corporate limits of the City of Batesville, Arkansas; that an accurate plat or map of said territory had been filed with and made a part of said petition; that proper notice had been given for the time and in the manner prescribed by law, and that all things pertaining thereto had been done in the manner prescribed by law, and that said lands and territory should be annexed to and made a part of the City of Batesville, Arkansas, subject to the acceptance of same by the City Council of said City at the proper time, as provided by law; and WHEREAS, the time fixed by law for appealing from said Order of Annexation made by the County Court has expired and no appeal has been taken from said Order. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: I SECTION 1. That the following described lands and territory contiguous and adjoining the City of Batesville, Arkansas, be and the same is hereby accepted as part of and annexed to and made a part of the City of Batesville. A part of the Northeast Quarter of the Northeast Quarter of Section 8, Township 13 North, Range 6 West, described thus: Commence at the Northeast corner of said Section 8, Township 13 North, Range 6 West and run North for 21.2 feet, thence run West 700.7 feet, to a fence corner, the Place of Beginning. Thence run South 1 degree 41 minutes West for 927.38 feet, along a wire fence to a fence corner; thence run South 56 degrees 40 minutes West 463.1 feet along said fence to a point, thence run South 67 degrees 11 • minutes West for 175.7 feet, along said fence to a point; thence run South 77 degrees 53 minutes West for 149.43 feet along said fence to a metal stake; thence run North 2 degrees 19 minutes East for 1,297.4 feet to a metal stake; thence run South 88 degrees 41 minutes East of 670 feet, to the Place of Beginning. This tract contains 17.8 acres, more or less. A Part of the Northwest Quarter of the Northeast Quarter of Section Eight (8) in Township Thirteen (13) North of Range Six (6) West, described by mets and bounds thus; Commencing at the Southwest corner of said NWY4 NEY4, thence North, along the line between said land and the Northeast Quarter of the Northwest Quarter of said Section 155 yards and two (2) feet for a Beginning Point; thence East 389 yards; thence South 155 yards and two (2) feet to the South Line of said NWY4 NEY4, thence along said South line to the dividing line between said NWY4 NEY4 and NEY4 NEY4; thence North along said dividing line to the Northeast corner of said Northwest Quarter of Northeast Quarter; thence West to the dividing line between the Northwest of the Northeast and the Northeast of the Northwest; thence South along said dividing line to the place of beginning, containing 27'/ acres, more or less, LESS AND EXCEPT, however, the following, Part of the NWY4 NEY4 of Section 8, Township 13 North, Range 6 West, described thus: Beginning at the Southwest Corner of said Quarter Section; thence North 155 yards and two (2) feet for a Beginning Corner; thence East 140 yards; thence North 70 yards thence West 140 yards to the West Line of said 40 acre tract; thence South on said West Line 70 yards to the PLACE OF BEGINNING, containing Two (2) Acres, more or less, in said Exception, said Exception shown in Deed Record D-5 P.359 to W.D. Dorsett. SECTION 2.
