HomeMy WebLinkAbout1997-10-01 . ! e ORDINANCE # AN ORDINANCE AMENDING ORDINANCE #801 AND ORDINANCE #95-5-2 AND THE BATESVILLE MUNICIPAL CODE CHAPTER 10.32, SECTIONS 10.32.02, 10.32.03, AND 10.32.05 REGARDING THE MEMBERSHIP, TERMS AND BOARD OF THE UTILITY COMMISSION ti BE IT ORDAINED BY'THE CITY COUNCIL OF THE CITY OF BATESVILLE, i ARKANSAS AS FOLLOWS: Sections 10.32.02, 10.32:03, and 10.32.05 of the Batesville Municipal Code which are the codification of Ordihances 801 of 1971 and 95-5-2 of 1995 shall be and are hereby amended to read as follows: 10.32.02— Commission M bers. The Batesville Utilities Commission shall be composed of five (5) members: Position A for a term of one (1) year; Position B for a term of (2) years; Position C for a term of three (3) years; Position D for a ter f four (4) years; and Position E for a term of five (5) years. Thereafter, a ointments to each position shall be for five (5) year terms. All comm' s.on members shall serve without pay. No commission member sha be\,financially interested in any contracts with the commission. 10.32.03 — Terms. No Commissio er shall serve a term in excess of five consecutive years. In the event that a commissioner resigns his or her position before theappoi ted expiration, the position shall be filled for the remaining term by an a ointment made by the City Council by majority vote of the elected ald man. No commissioner who has served a term of five consecutive ye alt shall be eligitmission or reappointment until that commissioner shall have been off the for one full year. 10.32.05 — President of Board. The President (chairperson) of the Batesville Utility Commission shall be the memberwho is serving the fourth (4tn) year of his or her rm. If that person declines the position of chairperson, an alternate willa elected by the board�� The members shall chose one (1) of their mem ers as secretary whosel,duty it shall be to have custody of the minutes and records, to supervise preparation of the minutes and to submit the minutes to the commission for approval. The president shall preside at all meetings except in his absence, a vice-chairperson, may be elected to preside and in the absence of the secretary, an assistant secretary may be elected. All officers must be members of the Commission. The remainder of Ordinance #801 and Ordinance #95-5-2 shall remain in full force and effect as originally enacted.
