An ordinance rezoning certain property in the City of Batesville, Arkansas
lying in Block 71, Maxfield's 3rd Eastern Addition to the City of Batesville,
Independence County, Arkansas.
WHEREAS, the City Planning Commission of the City of Batesville,
Arkansas, has conducted a public hearing on the petition of White River Medical
Center, Inc. for the rezoning of certain property lying in the City of Batesville,
Independence County, Arkansas, and the Planning Commission has recom-
mended to the Batesville City Council that the following described lands lying in
Batesville, Arkansas, be rezoned from Residential R-2 to Commercial C-2:
• Lots One(1), Two(2), Three(3), Four(4), Five(5), Six(6) and
Seven(7), Block 71, Maxfield's Third Eastern Addition to the
City of Batesville, Arkansas.
WHEREAS, after due notices as required by law, the Planning
Commission has heard all persons desiring to be heard on the question and has
determined that the property's best use is for commercial purposes and that the
property should be rezoned under the classification Commercial C-2. Other
property owners in the area will not be adversely affected by the rezoning
and the general public interest and welfare will not be adversely affected
by the rezoning.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Batesville, Arkansas:

(1) That the lands decribed herein shall be rezoned under the
classification Commercial C-2:
(2) That a copy of the ordinance duly filed by the City Clerk shall be filed
in the Office of the Recorder of the county and recorded in the Deed Records of
the county; and
(3) That it is hereby declared that an emergency exists and this
ordinance shall be in effect from and after its passage.
