HomeMy WebLinkAbout1998-04-01 ® ORDINANCE NO. AN ORDINANCE REZONING CERTAIN PROPERTY IN PT. SOUTHEAST QUARTER, NORTHEAST QUARTER, SECTION 23 AND PT. SOUTHWEST QUARTER NORTHWEST QUARTER, SECTION 24, ALL IN TOWNSHIP 13 NORTH, RANGE 6 WEST WHEREAS, Frankie Caldwell and Vickie Caldwell, his wife, filed before the Batesville Planning Commission a request for a change in zoning from R-1 to I-1, Light Industrial, for lands as hereinafter described in Independence County, Arkansas; and WHEREAS, a public hearing on said requested change was set before the Batesville Planning Commission on April 6, 1998 at 7 : 00 p.m. at the Batesville City Hall; and WHEREAS, notice of said public hearing was given in accordance . with the Batesville Zoning Code; and WHEREAS, Frankie Caldwell and Vickie Caldwell, his wife, met all technical requirements for submission of a request for zoning change as required by the City of Batesville Zoning Code, paid all costs and fees required, and said hearing was held in accordance with all requirements of the City of Batesville Zoning Code; and WHEREAS, at the public hearing of April 6, 1998 , Petitioners appeared in person and with their attorney, John C. Gregg; and WHEREAS, after a full and complete hearing, and upon motion duly made and seconded that the requested zoning change be granted and that the property be recommended to the City Council to be rezoned from R-1 to I-1, Light Industrial, the Batesville Planning Commission did approve and recommend the proposed zoning change of the hereafter captioned property from R-1 to I-1, Light Industrial; • and WHEREAS, the Batesville City Planning Commission adopted a written resolution recommending the zoning change and incorporated therein its reasons for the change; and WHEREAS, after all notices as required by law, the recommendation of the City Planning Commission for rezoning of the hereafter captioned lands from R-1 to I-1, Light Industrial, was set to be presented to the Batesville City Council on April 14, 1998 ; and WHEREAS, the Batesville City Council has heard all persons desired to be heard on the question and has determined that the hereafter captioned property should be rezoned from R-1 to I-1, ® Light Industrial. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1. That the following described lands in Independence County, Arkansas should be and hereby are rezoned from R-1 to I-1, Light Industrial. A part of the SE-14 of the NE-14 of Section 23 , Township 13 North, Range 6 West of the Fifth Principal Meridian, described thus: Beginning at a metal stake, the Southeast corner of the SE4 of the NE4 of Section 23 , thence N 010031E 376. 8 ft. to a metal stake on the South Right of Way of Highway 394 , thence N 490291 W 15 . 0 ft. along South Right of Way of Highway 394 to a metal stake, thence S 120521W 26 . 3 ft. to a metal stake on the East side of a water meter, thence S 250121W 389 . 9 ft. to a metal stake on South line of the SE4 of the NE4, thence S 870231E 176 . 6 ft. along South line of SE4 of the NE4 to point of beginning, containing . 81 Oacre more or less. • and A tract of land being part of the Southwest Quarter of the Northwest Quarter of Section Twenty-Four in Township Thirteen North Range Six West of the Fifth Principal Meridian (SW4 NW4, Sec. 24 , T13N R6W, 5th PM) in Independence County, Arkansas, more particularly described as follows: Beginning at the Southwest corner of said SW-14 NW-'4; thence run S 870231E, a distance of 152 . 8 feet; thence N 360391E, a distance of 195 . 4 feet to a point on the Southwest line of "Gap Road" ; thence run N 491081W along said Southwest Line, a distance of 346. 9 feet; thence run S O10031W, a distance of 376 . 8 feet to the Point of Beginning. Known as 460 Gap Road, Batesville, Arkansas 72501 Section 2 . The re-zoning granted by this Ordinance shall not be considered in any way in connection with any futher zoning ® request for the re-zoned property or property adjacent thereto. Section 3 . A copy of this Ordinance duly filed by the City Clerk shall be filed in the Office of the Recorder of the Circuit Clerk of Independence County, Arkansas and recorded in the deed records of said county, and published in accordance with Ark.
