HomeMy WebLinkAbout1998-07-01 ORDINANCE NO. AN ORDINANCE REZONING CERTAIN PROPERTY OWNED BY IDEAL r BAKING COMPANY, INC. AND ELMER L. COCHRAN, JR. FROM R-2 TO I-2, SAID PROPERTY BEING DESCRIBED AS LOT 4, BLOCK 76 OF MAXFIELD' S THIRD ADDITION TO THE CITY OF BATESVILLE, ARKANSAS AND FOR OTHER PURPOSES. WHEREAS, the City Planning Commission of the City of Batesville, Arkansas, has recommended to the Batesville City Council that the following lands lying in Batesville, Independence County, Arkansas, be rezoned from R-2 to I-2 . f Lot 4, Block 76 of Maxfield' s Third Addition to the City of Batesville, Arkansas . WHEREAS, after due notices as required by law, the Planning Commission and the City Council has heard all persons desiring to be heard on this question and has determined that the property' s best use is Industrial I-2 and that the property should be rezoned under the t classification of I-2 . i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: Section 1 : That the lands described as Lot 4, Block 76 ` of Maxfield' s Third Addition to the City of Batesville, Arkansas shall be and are hereby rezoned from Residential R- I F 2 to Industrial I-2 . Section 2 : A copy of this ordinance shall be filed by the City Clerk of the City of Batesville, Arkansas in the office of the Recorder of Deeds of this county and recorded �►` in the Deed Record Books of Independence County. Section 3: That the City Clerk shall cause the official zoning map of the City of Batesville, Arkansas, to note the change effected hereby. Section 4 : That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 5: IT IS HEREBY FOUND AND DECLARED THAT AN EMERGENCY EXISTS AND THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS PASSAGE FOR THE NECESSARY PROTECTION OF THE CITY' S HEALTH, SAFETY AND WELFARE. !{ PASSED and adopted this day of 1998 . f f I HO .
