AN ORDINANCE WAVING THE REQUIREMENTS OF COMPETITIVE
BIDDING FOR THE PURCHASE OF A SPECIALIZED TRUCK FOR THE
CITY OF BATESVILLE SANITATION DEPARTMENT: DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
SECTION 1: As codified in the Arkansas Statutes as Ark. Code Ann. Section
14-58-303 et seq. the requirements of competitive bidding is hereby waived
on the purchase of a used flatbed truck with dump.
SECTION 2: That the city council finds this is an exceptional situation
warranting waiver of bidding due to limited and available supply of such
vehicle and due to conditions of current city vehicle which is used by the city
sanitation department for timely pickup service on specialized waste.
SECTION 3: EMERGENCY CLAUSE — This purchase would be in the best
interest of the public's health, safety and general welfare and the timeliness of
said purchase being of the utmost importance and competitive bidding being
nonfeasible and nonpractical, an emergency is hereby declared and this
• ordinance shall be in full force and effect as of the date of its passage.
