HomeMy WebLinkAbout1999-01-01 i ORDINANCE NO. 9— " • AN ORDINANCE REPEALING ORDINANCE NUMBER 98-1-1, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, upon recommendation from the Batesville Planning Commission, the City Council rezoned the below described property on January 13, 1998, from Commercial C-2 to Commercial C-3: A tract of land being a part of the SW'/4, Section 13, Township 13 North, Range 6 West, a part of block 1 , a part of block 4, a part of block 5, a part of vacated Lark Street and a part of i vacated Mockingbird Street of Wolford's Quail Valley East Subdivision, all in the City of Batesville, Independence County, Arkansas, more particularly described as follows; Commencing at a point that is 1359.43 feet North and 816.72 feet West of the southeast corner of said SW'/4,said point being on the nominal west right of way line of Thunderbird Drive; thence North 72 Degrees 21 minutes 00 seconds West, 197.4 feet to the point of beginning; thence continue North 72 Degrees 21 minutes 00 seconds West, 203.52 feet; thence North 07 Degrees 35 minutes 33 seconds West, 261.35 feet; thence North 67 Degrees 28 ® I minutes 44 seconds East, 239.02 feet; thence South 22 Degrees 31 minutes 16 seconds East, 313.99 feet; thence South 42 Degrees 38 minutes 21 seconds West, 166.22 feet to the point of beginning. Containing 2.15 acres, more or less, subject to any and all easements. WHEREAS, the owner never published the ordinance; and WHEREAS, the owner has made request that the C-2 zoning be retained due to the fact it has been determined the property will not be used for public housing. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1: The above described property shall remain as Commercial C-2 and Ordinance No., 98-1-1 is hereby repealed. Section 2: It is hereby found and declared that an emergency exists and that this ordinance being necessary for the public welfare, it shall be in full force and effect from the date of its passage. An ordinance was previously passed to change a portion of the property zoning to C-3, but it was never recorded. The ordinance was associated with a special zoning request on four acres proposed for the Batesville Housing Authority. The transaction with the Housing Authority was canceled at their request and never came to fruition. It is NationsBank's desire, as current property owner, to maintain the current C-2 zoning across the entire parcel and eliminate the ordinance proposing a zoning change to C-3 for a portion of the property.
