AN ORDINANCE RE-ZONING CERTAIN PROPERTY OF
BELIEVERS OUTREACH CENTER CHURCH, INC. FROM
RESIDENTIAL R-1 TO COMMERCIAL C-2; DECLARING AN
EMERGENCY AND OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS, AS FOLLOWS:
(1) The following city property be and the same hereby is re-zoned from
Residential R-1 to Commercial C-2; said property presently owned by
Believers Outreach Center Church, Inc. and said owner is the
Petitioner for said zoning classification change.
(2) That the property is described thus:
A tract of land being a part of the NW'/4 of SW'/4 of Section 13,
Township 13 North, Range 6 West in the City of Batesville,
Independence County, Arkansas, more particularly described as
follows: Commencing at the Northeast corner of said NW'/4SW'/4;
thence North 89 degrees 27 minutes 16 seconds west along the North
line of said NW'/4SW'/4 a distance of 307.6 feet; thence South 02
• degrees 48 minutes 18 seconds West a distance of 236.46 feet to the
Point of Beginning; thence continue South 02 degrees 48 minutes 18
seconds West a distance of 200.0 feet; thence North 75 degrees 48
minutes 13 seconds west a distance of 215.48 feet; thence North 02
degrees 48 minutes 18 seconds East a distance of 157.37 feet; thence
South 87 degrees 11 minutes 42 seconds East a distance of 211.59
feet to the Point of Beginning, containing 0.87 acres, more or less.
Subject to a 20 foot utility easement along the South and East line of I
this tract and a 5 foot utility easement along the North and West line of
this tract.
In addition, a part of the Northern Half of the Southwest Quarter of
Section 13, Township 13 North, Range 6 West described by metes and
bounds as follows: Beginning at a point on the line between the
Northwest Quarter and the Southwest Quarter of said Section 13 a
distance of 1646 links East of the Quarter Section Corner between
Sections 13 and 14, said township and range; thence run South '/2
west 1033 links to the center of Highway 69; thence in a Westerly
direction and along said Highway 69 a distance of 7 yards to the Point
of Beginning of this conveyance; thence continue in a Westerly
direction a distance of 63 yards; thence run North 75 yards; thence run
East 63 yards; thence run South 75 yards to the Point of Beginning.
(3) It is hereby found and declared that an emergency exists and that this j
ordinance being necessary for the public welfare, it shall be in full force
and effect from the date of its passage.
