AN ORDINANCE SUBMITTING TO THE VOTERS OF THE
I CITY OF BATESVILLE, ARKANSAS AND OTHER AFFECTED
PERSONS, THE QUESTIONS OF ANNEXATION TO SAID
CITY OF BATESVILLE CERTAIN CONTIGUOUS TERRITORY.
WHEREAS, it appears to the Council of the City of Batesville, Arkansas, that
certain hereinafter described territory contiguous to the said City of Batesville is
necessary for the orderly growth of said City; and
WHEREAS, the lands furnish\the abode for a densely settled community or
represent the actual growth of the municipality beyond its legal boundary; and
WHEREAS, the lands are needed for proper municipal purposes; and
WHEREAS, the lands are valuable by reason of their adaptability for
prospective municipal uses,
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS:
Section1. That there shall be submitted to the qualified electors of the City of
Batesville and of the following described area:
Commence at the point where the north line of Section 18, Township
13 North, Range 5 West is intersected by the West R/W line of
Hwy #233; thence North with West R/W line of Hwy #233 to its intersection
with the North R/W line of Hwy #25, said point being on the East line of W'/z
of NW'/4 of Section 7, Township 13 North, Range 5 West; thence north
along the East line of W'/2 of W'/2 of Section 7, Township 13 North,
Range 5 West, the East line of W'/2 of W'/2 of Section 6, Township 13
North, Range 5 West, the East line of W'/2 of W'/2 of Sections 19, 30
and 31 in Township 14 North, Range 5 West to the NE corner of the
NW'/4 of NW'/4 of Section 19, Township 14 North, Range 5 West;
thence West along North line of NW'/4 of NW'/4 of Section 19,
Township 14 North, Range 5 West, and continue West along
North line of Sections 22, 23 and 24 in Township 14 North, Range 6
West to the NW corner of the NE'/4 of NE'/4 of Section 22, Township
14 North, Range 6 West; thence South along the West line of the
E'/2 of E'/2 of Sections 22, 27 and 34 in Township 14 North, Range 6
West to the SW corner of the SE'/4 SEY4 of Section 34, Township
14 North, Range 6 West; thence West along the Township line between
Township 13 North, and Township 14 North in Range 6 West to the
NW corner of Section 5 Township 13 North, Range 6 West; thence
South with West line of Sections 5 and 8, township -13 North, Range
6 West to the SW corner of said Section 8; thence West on North line
of Section 18, Township 13 North, Range 6 West to Dry Run Creek
and the present West City Limits of Batesville; thence South along
Dry Run Creek and said present West City Limits to North side of
ID ( Missouri Pacific Railroad; thence Easterly with North side of said
Railroad to the East side of Poke Bayou; thence Southerly and
Easterly with Poke Bayou to its intersection with North side of
White River; thence Easterly with North side of White River to its
intersection with West line of E'/2 of E'/2 of Section 25, Township 13
North, Range 6 West; thence North with West line of said E'/2 of E'/2
to the SW corner of NE'/4NE'/4 of said Section 25; thence East with

South line of Nr-1/4N to East line of Section 25; thence North with
East line of Sections 25 and 24, Township 13 North, Range 6 West
to the NE corner of said Section 24 and the current South City Limits
of Moorefield, Arkansas; thence West with North line of said Section
24 to the SW corner of said City Limits of Moorefield, Arkansas; thence
North with West line of Moorefield City Limits to its intersection with
Missouri Pacific Railroad; thence Easterly and Northerly with Moorefield
City Limits to the North line of Section 13, Township 13 North, Range
6 West; thence East with said North line of Section 13, Township 13
North, Range 6 West, and Section 18, Township 13 North, Range 5
West to the Pont of Beginning.
LESS AND EXCEPT, However, therefrom any portion of said lands which
lie within the present City Limits of Batesville, Arkansas.
The question of the annexation of the above described territory to the City of
Batesville.
Section 2. The question of annexation of the territory described above in
Section 1 shall be submitted to the electors qualified to vote on the issue at a Special
Election to be held on October 12, 1999. The City Clerk shall immediately notify the
County Election Commission by forwarding a certified copy of this ordinance.
• Section 3. If at such election a majority of the qualified electors voting in such
election shall vote for such annexation, the municipality shall proceed to file a
description and a map of the annexed area with the County Clerk of the county
wherein the land lies and with the Secretary of State. The annexation shall be
included within the corporate limits of the annexing city thirty (30) days following the
filing of the description and map with the County Clerk, or in the event an action is filed
with the Circuit Court, on the date the judgment of said Court becomes final. If a
majority of the qualified electors voting on the issue at the election vote against the
annexation, the annexation ordinance shall be null and void.
Section 4. If the annexation is approved and becomes final, the following
services shall be extended to the area within three (3) years:
SERVICE
City Fire Protection
City Sanitation Service
Animal Control
Street Lights (Where Needed)
Section 5. The ballots used at said election on the question of annexation shall
be marked as follows:
