AN ORDINANCE AMENDING ORDINANCE 83-5-1 AND THE BATESVILLE MUNICIPAL CODE CHAPTER 13.04 PERTAINING TO THE CITY PLANNING COMMISSION; CREATING A CITY PLANNING COMMISSION, DESIGNATING THE NUMBER OF PERSONS TO SERVE ON THE COMMISSION, PROVIDING FOR THE COMMISSION'S DUTIES, POWERS AND FUNCTIONS, PROVIDING FOR A MANNER OF APPOINTMENT, TERMS OF OFFICE AND VACANCIES, AND FOR OTHER PURPOSES. (BOLD PRINT INDICATES CHANGE FROM ORDINANCE NO. 83-5-1) BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1 : That Ordinance No. 83-5-1 and the Batesville Municipal Code Chapter 13.04 are hereby amended to read as follows: (1) There is hereby created a commission of and for the City of Batesville, Arkansas, to be known as designated as the "City Planning Commission", which commission shall consist of seven (7) members who shall serve without compensation and of whom not more than one-third (1/3) may • hold any other municipal office or appointment. (2) The City Planning Commission shall have and is hereby vested with all the duties, powers, and functions as set forth and prescribed by Act 186 of the Acts of the General Assembly for 1057 and all amendments thereto. (3) The members of the City Planning Commission shall be named and appointed by the Mayor, subject to confirmation and approval by the City Council. (4) The Planning Commission shall designate one (1) of its members as chairman and select a vice-chairman and such other officers as it may require. The terms of office of the chairman and other officers of the I Planning Commission shall be as provided by the rules of the Planning commission. (5) Regular meeting dates shall be established providing for at least one regular meeting to be held in each quarter of each calendar year. (6) The Planning Commission shall adopt rules and regulations for the discharge of its duties and the transactions of business, and shall keep a ® public record of all business, resolutions, transactions, findings and determinations. (7) The terms of office of the members of the City Planning commission shall be for five (5) years; provided, however, the initial appointments to the commission shall be one (1) member for a one (1) year term, one (1) member for a two (2) year term, one (1) member for a three (3) year term, one (1) member for a four (4) year term and one (1) member for a five (5) year term. As vacancies occur on said commission, Tor wnatevei ucause, said vacancy shall be filled in the manner herein provided, and said appointees, as well as all initial appointees hereunder, shall hold office until their successors are appointed and confirmed. ® (8) Upon the appointment of the members holding position number six (6) and position number seven (7) of said commission the person appointed to position number six (6) shall serve a term of four (4) years and the person appointed to position number seven (7) shall I i J .i serve a term of five (5) years and the successors for both positions shall be appointed for terms of five (5) years each. Section 3: The Board of Zoning Adjustment shall continue to consist of members of the Batesville Planning commission as provided by other ordinances of the City of Batesville. Section 4: Any ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 5: It is hereby declared that an emergency exists and this ordinance being necessary for the immediate preservation of the public peace, welfare and safety shall be in full force and effect from the date of its passage.
