AN ORDINANCE RE-ZONING CERTAIN PROPERTY OF THE CITY
OF BATESVILLE FROM R-2 RESIDENTIAL TO COMMERCIAL C-2;
DECLARING AN EMERGENCY AND OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS AS FOLLOWS:
(1) The following city property be and the same hereby is rezoned from R-2 Residential
to Commercial C-2; said property owned by the City of Batesville was the petitioner
for the said zoning classification change.
(2) That the property is described as thus: A tract of land being a part of the NE 1/4 of
Section 21, T 13 N,R 6 W in the City of Batesville, Independence County, Arkansas,
more particularly described as follows: Commencing at the northeast corner of said
Section 21;thence N 90 degrees 00 feet 00inches W, 1337.85 feet;thence S 00
degrees 00 feet 00 inches W, 1726.74 feet to the point of beginning;thence N 64
degrees 05 feet 30 inches E, 138.85 feet to the nominal south edge of an asphalt road;
thence along said nominal south edge the following;the following: S 65 degrees 57
feet 18 inches E, 11.71 feet; S 47 degrees 01 foot 15 inches E, 20.33 feet; along a
curve to the left said curve having a long chord bearing of S 77 degrees 21 feet 21
inches E, a long chord distance of 51.81 feet;N 72 degrees 18 feet 32 inches E, 14.86
feet; along a curve to the right said curve having a long chord bearing of S 72 degrees
27 feet 30 inches E, a long chord distance of 16.35 feet; S 37 degrees 13 feet33 inches
E, 72.58 feet; S 12 degrees 31 feet 24 inches E, 12.99 feet to the nominal north edge
of a crushed stone drive;thence along said nominal north edge the following; S 37
degrees 11 feet 19 inches W, 33.77 feet; S 60 degrees 16 feet 20 inches W, 25.23 feet;
S 12 degrees 44 feet 30 inches W, 56.03 feet; S 33 degrees 31 feet 55 inches W 21.12
feet;thence S 59 degrees 40 feet and 33 inches W, 97.91 feet to the nominal east face
of a rock wall; thence N 32 degrees 05 feet 47 inches W, along said nominal east face
and along the extension of said east face, 237.80 feet to the point of beginning.
Containing 0.95 ACRES, more or less.
(3) It is hereby found and declared that an emergency exists and that this ordinance being
necessary for the public welfare, it shall be in full force and effect from the date of its
passage.
