AN ORDINANCE RE-ZONINGCERTAIN PROPERTY OF BILL WOLFORD FROM R-2 RESIDENTIAL TO COMMERCIAL C-2; DECLARING AN EMERGENCY AND OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS AS FOLLOWS: (1) The following city property be and the same hereby is rezoned from R-2 Residential to Commercial C-2; said property presently owned by Bill Wolford was the petitioner for the said zoning classification change. (2) That the property is described as thus: a tract of land being a part of the NW 1/4 and a part of the SW 1/4 of Section 13, T 13 N, R 6 W in the City of Batesville, Independence County, Arkansas, more particularly described as follows; beginning at the southeast corner of said NW 1/4;thence S 02 degrees 26 feet and 49 inches W along the east line of said SW 1/4, 23.97 feet to the north right of way line of Harrison Street;thence along said north right of way line the following: S 88 degrees 38 feet and 51 inches W, 40.47 feet; S 75 degrees 04 feet 53 inches W, 26.05 feet; S 59 degrees 26 feet and 21 inches W, 128.93 feet; S 78 degrees 16 feet and 43 inches W, 69.93 feet; S 71 degrees 43 feet and 03 inches W, 3 44.3 4 feet;thence N 01 degrees 03 feet and 25 inches E, 711.70 feet; thence along a curve to the left said curve having a long chord bearing of N 16 degrees 05 feet and 36 inches W, a long chord distance of 345.00 feet; thence N 56 degrees 45 feet and 24 inches E, 65.00 feet to the nominal south right of way line of a proposed road; thence along said nominal south right of way line the following: S 56 degrees 10 feet and 11 inches E, 318.69 feet; along a curve to the right said curve having a long chord bearing of S 31 degrees 48 feet and 01 inches E and a long chord distance of 189.77 feet;thence S 88 degrees 56 feet and 35 inches E, 244.07 feet to the east line of said NW 1/4;thence S 00 degrees 49 feet and 58 inches W, 516.12 feet to the point of beginning. Containing 10.10 ACRES, more or less. (3) It is hereby found and declared that an emergency exists and that this ordinance being necessary for the public welfare, it shall be in full force and effect from the date of its passage.
