• ORDINANCE NO.
AN ORDINANCE REZONING CERTAIN PROPERTY OF INDEPENDENCE
COUNTY FROM R-1 RESIDENTIAL TO C-2 COMMERCIAL;DECLARING AN
EMERGENCY AND OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS AS
FOLLOWS:
(1) The following city property be and the same hereby is rezoned from R-1 Residential
to C-2 Commercial; said property presently owned by Independence County was the
petitioner for the said zoning classification change.
(2)That the property is described as thus: Legal description of land: A tract of land being
a part of the NW 1/4 of the SE 1/4 of Section 13, T 13 N,R 6 W in Independence County,
Batesville,Arkansas, more particularly described as follows: commencing at the
northwest corner of said NW 1/4, SE 1/4;thence S 01 degrees 55' 11"W along the west
line of said NW 1/4, SE 1/4, 142.59 feet;thence N 74 degrees 46' 00"E, 51.00 feet;thence
S 00 degrees 44' 50"W, 9.02 feet to a point on the south right of way line of Harrison
Street;thence N 82 degrees 10' 11"E along said south right of way line, 288.28 feet;
thence N 89 degrees 16' 51"E along said right of way line, 134.99 feet;thence S 00
degrees 44' 51"W, 43 2.3 7 feet to the point of beginning; thence continue S 00 degrees
44' 51"W, 210.00 feet; thence N 89 degrees 15' 09"W, 420.00 feet;thence N 00
degrees 44' 51"E, 210.00 feet;thence S 89 degrees 15' 09"E,420.00 feet to the point of
beginning. Containing 2.03 acres, more or less.
(3) It is hereby found and declared that an emergency exists and that this ordinance being
necessary for the public welfare, it shall be in full force and effect from the date of its
passage.
