BEFORE THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS
AN ORDINANCE GRANTING A ZONING CHANGE FOR CERTAIN PROPERTY
ALONG HARRISON STREET FROM R-1 TO C-2 COMMERCIAL,
AND FOR OTHER PURPOSES
WHEREAS, a tract of land on Harrison Street, containing approximately 8.83 acres
was annexed into the city and automatically zoned R-1, Residential, said tract described as
follows, to-wit:
A tract of land being a part of the North Half of the Southwest Quarter of
Section Fourteen (14) in Township Thirteen (13) North and Range Six (6)
West in Independence County, Arkansas, more particularly described as
follows:
beginning at a point on the east right of way line of Harrison Street, said point
being 2147.08 feet north and 661.19 feet east of the southwest corner of said
® Section 14; thence northeasterly along said right of way line and along a curve
to the right, said curve having a radius of 2501.79 feet, a distance of 94.25
feet; thence N 49°31'30" W along said right of way line a distance of 5.00
feet; thence N 40°28'30" E along said right of way line a distance of 141.28
feet; thence S 89°35'35" E a distance of 847.33 feet; thence S 16°55'30" E
along the meanders of a fence a distance of 311.05 feet; thence S 79°15'00"
W along a fence a distance of 210.0 feet; thence S 16°55'30" E along a fence
a distance of 205.00 feet; thence N 77'14'40" W along a fence a distance of
220.00 feet thence N 75'24'20" W along a fence a distance of 250.00 feet;
thence S 78°46'10" W along a fence a distance of 33.14 feet; thence N
60°53'24" W a distance of 515.37 feet to the point of beginning. Containing
8.83 acres, more or less; and
WHEREAS, an Application For A Zoning Change was duly filed with the Planning
Commission for the City of Batesville, Arkansas asking the Planning Commission to propose
and recommend the zone of the above described real property be changed from R-1 to C-2;
and
WHEREAS, after due notice as required by law, a hearing was held before the
Batesville Planning and Zoning Commission wherein said rezoning was recommended; and
the Planning Commission has ascertained that the property described is located in an area
zoned for R-1 residential; and that the public interest, and welfare will be best served if the
subject property is rezoned from R-1 to C-2, Commercial, in keeping with the character of
the surrounding property;

NOW BE IT THEREFORE ORDAINED, that the subject property is rezoned from
R-1 to C-2, Commercial.
2. A copy of the ordinance, duly certified by the City Clerk, shall be filed in the
office of the recorder of the county and recorded in the deed of records of the county, and
published as required by law.
