HomeMy WebLinkAbout2000-12-01 I ORDINANCE NO. 2000- IA—I i AN ORDINANCE REPEALING ORDINANCE NO. 91-1-3 FIXING RATES FOR WATER TO BE FURNISHED BY THE WATERWORKS SYSTEM OF THE CITY OF BATESVILLE i WHEREAS, the Water Utilities Commission of the City of Batesville has determined that additional revenue is required to compensate for the increased cost of water, materials, operation, maintenance and depreciation of the Waterworks System, and to provide for the extensions, betterments and improvements that will be necessary from time to time to meet the needs of the City of Batesville; and WHEREAS, in order to accomplish said requirements, it is necessary that the rates for the services of the Waterworks System be increased; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY • OF BATESVILLE, ARKANSAS: Section 1: Ordinance No. 91-1-3 is hereby repealed. Section 2: Hereafter, the following definitions shall apply to be used in interpretation and administration of Batesville water rates, to-wit: 1. Residential Users are defined as those using water services in or appurtenant to a structure used or designed for use as a dwelling place, whether for single or multiple occupancy, excluding hotels and motels. 2. Commercial Users are defined as those using water services in or appurtenant to a structure used or designed for use as a place of business, including hotels and motels, but excluding industrial users. 3. Industrial Users are defined as those using water services in or appurtenant to a structure or enclosure used or designed for use as a place for manufacturing or processing • goods. 4. Wholesale Users are defined as any municipality, water association, I improvement district, or legal entity desiring to purchase water from the City of Batesville for b Section 3: Commencing with the January 1, 2001 billing period, the following monthly rates shall be, and they are hereby, fixed as rates to be charged for water furnished by the I I Waterworks System of the City, which rates the Council finds and declares to be reasonable • and necessary rates to be charged. i I I i I A. CUSTOMERS INSIDE CITY LIMITS: Subject to the conditions hereinafter set out, the charges for water services and water usage for each customer inside the city limits shall be based on the customer's meter size and the customer's metered water usage in accordance with the schedules shown below. I 1. Minimum Charges Per Month for First Thousand Gallons or Part Thereof Per Meter Size: I Residential, commercial, and industrial user customers inside the city limits shall pay the following minimum monthly rates for the first one thousand (1,000) gallons or any part thereof of metered water usage based upon meter size: Meter Size Minimum Charge for 0-1000alg lons 8" $960.00 6" $552.00 4" $252.00 • 3" $144.00 2" $ 60.00 1" $ 15.00 5/8" $ 6.00 1/259 $ 6.00 2. Water Rates For Water Usage Over One Thousand Gallons Per Month: Residential, commercial, and industrial user customers inside the city limits shall be the following rates for metered water usage in excess of one thousand (1,000) gallons per month. A. More than 1,000 gallons and up to 100,000 gallons - $2.31 per thousand gallons. B. More than 100,000 gallons and up to 2,000,000 gallons - $1.76 per thousand gallons. C. More than 2,000,000 gallons - $1.38 per thousand gallons. • DETERMINATION OF METER SIZE The size of the meter shall be commensurate with the potential use of water(maximum rate of demand), and shall be determined by the water utilities commission. B. CUSTOMERS OUTSIDE CITY LIMITS: Subject to the conditions hereinafter set out, the charges for water services and water • usage for each residential, commercial, or industrial user customer outside the city limits shall 2 • � 1 be based on the customer's meter size and the customer's metered water usage in accordance with the schedules shown below: I 1. Water Rates For Water Usage Over One Thousand (1,000) Gallons Per Month: • Customers outside the city limits shall pay the following rates for metered water usage in excess of one thousand (1,000) gallons per month. A. More than 1,000 gallons and up to 100,000 gallons—$2.89 per thousand gallons. B. More than 100,000 gallons and up to 2,000,000 gallons—$2.20 per thousand gallons. C. More than 2,000,000 gallons—$1.73 per thousand gallons. DETERMINATION OF METER SIZE The size of the meter shall be commensurate with the potential use of water(maximum rate of demand), and shall be determined by the water utilities commission. i Section 4: WHOLESALE USER RATES Any municipality, water association, improvement district, or other legal entity which • purchases water for resale shall purchase 0-1000 gallons per month at a rate to be fixed by contract but not less than the minimum charge for zero to one thousand gallons of monthly i water usage charged to customers outside the city limits per meter size. All water in excess of the first one thousand (1,000) gallons per month shall be purchased by wholesale customers at a rate to be fixed by contract, but not less than $1.73 per thousand gallons. I METERS • Section 5: Meters shall be installed at each water connection at all buildings, both public and private. There shall be no more than one Residential single family dwelling on a 3 i i • single meter. At the option of the owner of a building or buildings having multiple occupancy, multiple meters may be installed or a single meter may be utilized. In the event that a single meter is utilized for a building having multiple residential housing unit occupancy, except hotels and motels, the water minimum rate shall be calculated by multiplying the number of housing units times the single monthly minimum user rate. Mobile home parks, apartment complexes, and other similar aggregates having more than one structure in a group utilizing a single meter shall be subject to the same rate as multiple occupancy residential housing buildings. Hotels and motels shall be and are hereby classified as single occupancy commercial structures and shall be subject to the water use rate of a single meter user. BILLING—LATE PAYMENT Section 6: Bills for water shall be rendered monthly, and if not paid on or before • the twentieth day following the original date of billing, a 10 percent penalty shall be added to the bill. If the bills are not paid on or before the thirtieth day, service shall be discontinued and the premises involved shall be disconnected from the System. In the event service to any premises shall be disconnected, a service charge of$15.00 in addition to all other charges that may be payable shall be paid for reconnection to the System. And in this regard, if any such charges are paid at the time the service person goes out to disconnect the service from the premises, a charge of$10.00 (instead of the $15.00 above specified in the event of a reconnection) shall be paid in addition to all other charges then payable. PRIVATE FIRE CONNECTIONS I Section 7: Private fire connections for private premises shall pay the following fire • � I service charges per year: a) Automatic sprinkler system connections, - (1) 1,000 heads or less - $432.00 annually (2) For systems containing more than 1,000 j x� 7 4'11312.010 t., $'01.48 for each head in excess of 1,000 annually b) Private fire hydrants; standard hydrant - $432.00 annually with two 2.5inch standard hose connections. (each) Standard hydrant with one 2.5 inch - $312.00 annually ® hose connection. (each) 4 f i i C) The service charge for fire hose stand pipes shall be: 1.2.5 inch diameter openings, - $ 29.00 annually or smaller (each) I 1.5 inch diameter openings - $ 48.00 annually (each) 2 inch diameter openings - $ 108.00 annually (each) 2.5 inch diameter openings - $216.00 annually (each) i i INOPERATIVE METERS Section 8: Should a customer's meter be determined by the Water System Manger to be inoperative or faulty,the customer's monthly usage charge for the purpose of billing shall be the average usage of the three previous months that the meter was determined to be functioning properly. Should the meter failure be determined to have been a failure of • three months or more,the customer shall be liable for water charges during the months of meter failure based on the average of the water usage for the twelve months prior to the meter failure. REPEAL OF CONFLICTING PROVISIONS Section 9: All other ordinances and resolutions of the City of Batesville, Arkansas, in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict, but same shall remain in full force and effect to the extend there is no conflict with the provisions of this Ordinance. SEPARABLE PROVISION Section 10: The provisions of this Ordinance are separable and if a section, phrase or provisions shall be declared invalid, such declaration shall not affect the validity of the remainder of the Ordinance.
