HomeMy WebLinkAbout2001-01-03 BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS ORDINANCE N4 2001-1-3 AN ORDINANCE ACCEPTING THE EXTENSION OF MILL RUN TRAIL, TRESTLE COURT AND EQUITY COURT, SAWMILL SUBDIVISION, SECOND ADDITION TO THE CITY OF BATESVILLE, INDEPENDENCE COUNTY, ARKANSAS, INTO THE STREET MAINTENANCE PROGRAM AND FOR OTHER PURPOSES, AND DECLARING AN EMERGENCY WHEREAS, Zachary F. Mobley and Lenora B. Mobley, his wife, have delivered a Deed of Dedication and Bill of Assurance as shown by Amended and Substituted Deed of Dedication and Bill of Assurance recorded August 28, 1998, in Book M-16, Pages 469- 480 of the Independence County Records, by the First Amendment to Amended and Substituted Deed of Dedication and Bill of Assurance to Sawmill Subdivision, Second Addition recorded in Book R-16, Pages 301-306 of the Independence County Records, and by a final plat amended of said Sawmill Subdivision, Second Addition in Plat Book I, Pages 120 of the Independence County Records (collectively referred to herein as "the Sawmill Subdivision Second Addition Deed of Dedication") for certain lands in the City of Batesville to be used as City Streets and public rights-of-way; and WHEREAS, Zachary F. Mobley and Lenora B. Mobley have now constructed streets upon all portions of the plat dedicated for streets, in accordance with the specifications and requirements of the City of Batesville. BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: i 1. The streets described in the Sawmill Subdivision Second Addition Deed of Dedication are accepted by the City of Batesville; 2. Pursuant to Batesville Municipal Code § 9-32.01, the streets shall be known as Mill Run Trail, Trestle Court and Equity Court; and 3. Mill Run Trail, Trestle Court and Equity Court, as described in the above referenced Sawmill Subdivision Second Addition Deed of Dedication will be added to the Master Street Plan in accordance with § 9.44 of the Batesville Municipal Code. Emergency Clause. This Ordinance being necessary for the security and well being of the City of Batesville, an emergency is declared to exist and this Ordinance will be effective from and after its passage.
