HomeMy WebLinkAbout2001-09-01 ORDINANCE NO. 2001-9-1 AN ORDINANCE ESTABLISHING A PROCEDURE FOR REQUEST FOR WATER SERVICE OUTSIDE THE BATESVILLE CITY LIMITS WHEREAS, the Batesville Utilities Commission, was established by a majority vote of the Batesville City Council and charged with the duty and authority to construct, reconstruct, build, maintain and repair the water and sewer treatment plants, distribution and collection systems for the City of Batesville, Arkansas; and, WHEREAS, the Batesville City Council has charged the Batesville Utilities Commission with the responsibility of assuring an adequate capacity of water to the citizens of Batesville; and, WHEREAS, the City of Batesville may receive request for water services from residential users, commercial users, industrial users and wholesale users outside the Batesville, Arkansas City Limits; and WHEREAS, the purpose of the Batesville City Council and the Batesville Utilities Commission is to serve the Citizens of Batesville, Arkansas; NOW THEREFORE be it ordained by the City Council of the City of Batesville, Arkansas: That contracts to sell water to residential users, commercial users, industrial users and wholesale users outside the City limits of Batesville, Arkansas or for Wholesale users who purchase water inside the City limits for resale outside the Batesville City limits must be approved first by the Batesville Utilities Commission and then referred to the City Council of the City of Batesville where it must be approved by a majority vote. EMERGENCY CLAUSE: It is hereby declared that an emergency exists and this ordinance being necessary for the immediate preservation of the public peace, welfare and safety shall be in full force and effect from the date of its passage.
