HomeMy WebLinkAbout1990-12-01 • ORDINANCE NO. 90-12-1 AN ORDINANCE AMENDING ORDINANCE NO. 892 OF 1978 AS AMENDED; WITH RESPECT TO THE ESTAB- LISHMENT OF RATES FOR SEWER SERVICES; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. WHEREAS, the Water Utilities Commission of the City of Batesville owns and operates sewage collection, pumping and treatment facilities (treatment works) ; and WHEREAS, in order to finance the proper and reasonable expense of operation, repair, replacements and maintenance and for the payment of sums required to retire the bonded debt of the treatment works; and • WHEREAS, it is necessary for the City to establish rates which will provide a more equitable share of total revenues from users of the treatment works; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS : Section 1 : That Ordinance No . 892, Section 5 (a) is hereby repealed and the following is substituted therefor: Sewer (a) The monthly rate for sewer services of the System shall be as set forth below for users located in the City. Monthly sewer charges shall be based upon water con- sumption. The Utilities Commission shall classify all users of the sanitary sewer system (user being hereby defined as any landowner whose buildings or premises are connected with and use the sanitary sewer system of the City or otherwise discharges sewage, industrial waste, water or other liquids either directly or indirectly into the sewer system of the City) as either domestic or commercial on the basis of whether the water consumption for the individual user is used for domestic or commercial purposes . In the case of domestic users, the average monthly water consumption for the months of January, February and March of the current year in which sewer bills are rendered and the month' s of October, November, and December of the preceeding calendar year shall be computed separately for each domestic user and a uniform monthly charge for each domestic user shall be determined by applying the following schedule of rates to the average monthly water consumption so computed. In the event a new customer has not established a six winter months average as set out above, the billing shall be based on the actual month ' s usage until a six winter month usage average has been determined. In the case of commercial users, the monthly water consumption for the month in which the sewer bills are rendered shall be computed separately for each commercial user and the sewer charge for each commercial user shall be determined by applying the following schedule of rates to the monthly water • consumption so computed; provided that in the case of a commercial customer using an appreciable amount of water that does not reach the sewer system, the Utilities Commission, upon request by such commercial user, shall determine the volume of the water usage that does reach the sewer system and the following schedule shall be applied to that volume . Beginning January 1 , 1991 the following schedule of rates shall be applied: First 1 , 000 gallons or part thereof : $3 . 00 (minimum charge) All over 1 , 000 gallons : $1 . 15 per 1 , 000 gallons . • Effective July 1 , 1991 the following schedule of rates shall be applied: First 1 , 000 gallons or part thereof : $3 . 00 (minimum charge) All over 1 , 000 gallons : $ 1 . 45 per 1 , 000 gallons . For users of the sanitary sewer system who do not use water provided by the City ' s water system (or an appreciable amount 2 - thereof) water consumption and sewer discharge shall be deter- mined by the Utilities Commission where feasible, and the schedule of rates set forth above shall be applied. Where such determi - nation is not feasible the monthly charge shall be as follows : (i) Domestic, $17 . 50; and (ii) Commercial, $26 . 00 . (b) For users of the sanitary sewer system located outside the City, the monthly rates for sewer services of the System shall be 125% of the sewer rates set forth above for users located in the City. Section 2 : None of the facilities or services afforded by the sewage treatment works shall be furnished without a charge being made therefor. Any vacant, unoccupied property attached to the • sewer system having an in- service water meter shall be considered to be a contributor to the sewer system at such time as a sewer tap is completed and as such is subject to the monthly usages and services set forth in the above mentioned rate structure . Section 3 : That the City Council hereby finds and declares that the above sewer rates are fair, reasonable and necessary minimum rates, and will produce revenues at least sufficient for the reasonable operation and maintenance expenses of the sewage treatment works, the payment of the sewer facilities fair share of the principal and interest on the revenue bonds as they mature and the paying agents fees (including establishing and maintaining a reserve) , and to provide depreciation funds for replacement or repairs of the sewer facilities . Section 4 : That the provisions of this Ordinance are separable and if a section, phrase or provision shall be declared invalid, such declaration shall not affect the validity of the remainder of this Ordinance . Section 5: That all ordinances or parts of other ordinances in conflict herewith are hereby repealed. • 3 PASSED AND APPROVED this 11th day of December , 1990.
