AN ORDINANCE REPEALING ORDINANCE NO. 963; FIXING RATES FOR WATER TO BE FURNISHED BY THE WATERWORKS SYSTEM OF THE CITY OF BATESVILLE; PERTAINING TO OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY WHEREAS, the Water Utilities Commission of the City of Batesville has determined that additional revenue is required to compensate for the increased cost of water, materials, operation, maintenance and depreciation of the Waterworks System, and to provide for the extensions, betterments and improvements that will be necessary from time to time to meet the needs of the City of (Batesville; and I� WHEREAS, in order to accomplish said requirements, it is �III necessary that the rates for the services of the Waterworks System be increased. �) NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS : Section 1 : Ordinance No. 963 is hereby repealed. Section 2 : Hereafter, the following definitions shall apply and be used in interpretation and administration of Batesville water rates, to-wit: 1 . Residential Users are defined as those using water i services in or appurtenant to a structure used or designed for use ; I as a dwelling place, whether for single or multiple occupancy, ( excluding hotels nd motels . j 2 . Commercial Users are defined as those using water services in or appurtenant to a structure used or designed for use 11as a place of business, including hotels and motels, but excluding i industrial users . 3 . Industrial Users are defined as those using water I services in or appurtenant to a structure or enclosure used or i designed for use as a place for manufacturing or processing goods . it 4 . Wholesale Users are defined as any municipality or improvement district or legal entity desiring to purchase water from the City of Batesville for resale by individual metering . ! I I Section 3 : Commencing with the February 1 , 1991 billing period, the following monthly rates be, and they are hereby, fixed as rates to be charged for water furnished by the Waterworks Sypteff of the City, which rates the Council finds and declares to be reasonable and necessary minimum rates to be charged: A. Customers Inside City Limits Subject to meter minima and penalties hereinafter set out, the charges for water service and water usage for each j I ( residential, commercial and industrial customer shall be determined each month and shall be computed based on the customer ' s meter $iz and the customer ' s metered water usage and the Schedules of Rates and B below: Schedule A Water Rates • For the first 1 , 000 gallons - $5 . 40 of consumption per month or portion thereof (the minimum bill) For the next 99, 000 gallons - $2 . 19 per 1 , 000 gallons of consumption per month or portion thereof For the next 1 , 900, 000 - $1 . 46 per 1 , 000 gallons gallons of consumption per month or portion thereof For all monthly consump- - $1 . 00 per 1 , 000 gallons tion over 2, 000, 000 gallons of water per month Schedule B Monthly Minima The minimum monthly bill shall be determined by the size of the meter installed and shall be as follows : 5/8" meter $ 5 . 40 ® 1 " meter $ 12 . 50 1 - 1 /2" meter $ 60 . 00 2" meter $ 65 . 00 3 " meter $ 92 . 00 4 " meter $ 244 . 00 6 " meter $ 562 . 00 The size of the meter shall be commensurate with the potential � se of water, and shall be determined by the Water Utilities Commission. 2 • I B. Customers Outside City Limits Each individual residential, commercial and industrial i customer receiving water service outside the city limits shall be billed for water consumption, subject to meter minima and penaltieJ as hereinafter set out. Section 4 : Wholesale User Rates : Any municipality or improvement district or leqal entity desiring to purchase water from the City of Batesville for resale by individual metering shal 1purchase water at the rate of $ 1 . 25 per 1 , 000 gallons and shall) be ', 11 1subject to the meter minima established in Schedule D above unless • the rates and minima are otherwise established by written contract I between the wholesale user and the Batesville Utilities Commission. 3 1 I . Section 5 : Meters shall be installed at each water connection at all buildings, both public and private . Mobile home parks,) apartment complexes, and other similar aggregates having more than , one structure in a group utilizing a single meter shall be subject ! to the same rate as multiple occupancy residential housing • buildings . Hotels and motels shall be and are hereby classified as single occupancy commercial structures and shall be subject to the water use rate of a single meter user. Section 6 : Bills for water shall be rendered monthly or bi - monthly, at the option of the City, and if not paid on or before the twentieth day following the original date of billing, a 10 I percent penalty shall be added to the bill . If the bill is not paid on or before the thirtieth day, service shall be discontinued and the premises involved shall be disconnected from the System. �(In the event service to any premises shall be disconnected, a ((service charge of $15 . 00 in addition to all other charges that may I�be payable shall be paid for reconnection to the System. And in this regard, if any such charges are paid at the time the service ® ( man goes out to disconnect the service from the premises, a charge of $10 . 00 (instead of the $15 . 00 above specified in the event of a reconnection) shall be paid in addition to all other charges then pavable . 4 I • Section 7 : Private fire connections for private premises (shall pay the following fire service charges per year: 1 a) Automatic sprinkler system - $350 . 00 connections, 1 , 000 heads or less For systems containing more than 1 , 000 heads, the charge shall be $350 . 00 plus $0 . 35 for each head in excess of 1 , 000 . b) Private fire hydrants; standard - $350 . 00 annually hydrant with two 2 - 1 /2 inch (each) standard hose connections . Standard hydrant with one - $250 . 00 annually 2 - 1 /2 inch standard hose (each) connection. c) The service charge for fire hose stand pipes shall be: 1 - 1 /4 inch diameter openings, - $ 20 . 00 annualllyi or smaller (each) 1 - 1 /2 inch diameter openings - $ 35 . 00 annuaiiy � • (each) 2 inch diameter openings - $ 87 . 50 annuallyi (each) 2 - 1 /2 inch diameter openings - $175 . 00 annually (each) i Section 8 : Should a customer ' s meter be determined by the Water System Manager to be inoperative or faulty, the customer 's monthly usage for the purpose of billing shall be the average u'sag of the three previous months that the meter was determined to be I functioning properly. Should the meter failure be determined to have been a failure of three months or more, the customer shall be liable for water charges during the months of meter failure based on the average of the water usage for the twelve months prior t the meter failure . Section 9 : All other ordinances and resolutions of the City of Batesville, Arkansas, in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict, but same shall remain in full force and effect to the extent there is no conflict with the provisions of this Ordinance . • 5 i 0 • Section 10: The provisions of this Ordinance are separable I� and if a section, phrase or provision shall be declared invalid, such declaration shall not affect the validity of the remainder of lthe Ordinance. Section 11 : It is hereby ascertained and declared that the resent water rates for the City are inadequate to provide sufficient funds for present operation cost of water, maintenance, epreciation and debt service requirements, and must be increased to the level set forth herein for that purpose and to produce sufficient income to provide financing for extensions, betterments and improvements . It is therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public peace, health and safety shall take effect and be in force Jz6u� cic1 19 • j PASSED AND APPROVED this day of �11?1,16t,lct 1991 .
