AN ORDINANCE FOR THE AUTHORIZATION AND APPROVAL OF AN AMENDMENT
TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF BATESVILLE AND
INDEPENDENCE COUNTY, ADDING TWO MEMBERS TO THE BOARD, DECLARING
AN EMERGENCY, AND FOR OTHER PURPOSES .
Section l : Paragraph L of the Interlocal Agreement which was
passed by the City of Batesville pursuant to Ordinance No . 970 is
hereby amended to read as follows :
(L) There shall be a Board created by the City and the
County for the purpose of effectuating this Agreement
and coordinating the efforts necessary for carrying out
this Agreement . This Board shall consist of the
Sheriff of the County , the Mayor of the City , the
County Judge , one member of the City Council of the
City of Batesville appointed by the Mayor and approved
by the City Council and one member of the Quorum Court
of Independence County appointed by the County Judge
and approved by the Quorum Court . The Board members
from the Quorum Court and the City Council shall serve
one ( 1 ) year terms . The sole purpose of this Board
shall be to carry out the purposes of the Agreement and
to coordinate the effort of the parties that may arise
from time to time . This Board shall meet as the need
arises but on at least a monthly basis . The Board may
elect to hold quarterly meetings on the approval of the
Quorum Court and the City Council . The meetings will
be called by the City Clerk and the County Clerk , one
of whom will be represented at the meetings for the
purpose of keeping minutes . They shall thereafter
report to the parties so represented as to the
financial status and effectuation of this Agreement .
The Board shall in no way be construed to be a Civil
Service Commission or Grievance Committee and shall
only serve for the effectuation and coordination of
this Agreement .
SECTION A.
If within any twelve month period either party wishes to
terminate this agreement they may do so by giving the other
party six months written notification and the agreement will
terminate at the end of the six month notice period.

SECTION B.
The Metropolitan Branch will be a department within the
Sheriff ' s Office, and an experienced senior deputy with the rank
of Lieutenant will be appointed to oversee the department . He
will maintain communication with the Interlocal Board and, as
necessary, with the Mayor and City Council .
SECTION C.
PART I . Said persons for the Metropolitan Branch shall be
composed of 3 positions of upper level deputy sheriff (one
lieutenant and two sergeants ) , one investigator , 8 deputies , and
one part-time clerk. Salaries paid will be in accordance with
the overall pay scale of the Sheriff ' s Department in such a way
that there would be no salary advantage or disadvantage for
personnel of the Metropolitan Branch.
PART II . Experienced Metropolitan personnel will not be
transferred to the county without being replaced with persons of
like experience. If new personnel must be trained for Metro
positions the City and county will share in the cost of training
on an equitable basis which will be reviewed and approved by the
Interlocal Board. If additional Personnel are needed for the
Metro Department , the Sheriff should make a request to the
Interlocal Board . If the Board concurs with the request it will
recommend the addition to the Batesville City Council . If
approved by the City Council , the new personnel will be added.
SECTION D.
The Metropolitan vehicles will be identified with a
distinctive striping and will be used in and near the City of

Batesville unless an emergency or unusual circumstances will
require their use away from the city. Any significant use of the
Metropolitan vehicles away from the city shall be reported to the
Interlocal Board by the Sheriff .
Section 2: This Amendment is made pursuant to Paragraph M of the
Interlocal Agreement . This Amendment shall take effect only if
approved by majority of both the Independence County Quorum Court
and the City Council of the City of Batesville.
Section 3 : Emergency Clause - As law enforcement is a continuing
service of the County and City to its citizens and this Board has
been charged with the coordination and effectuation of the
Interlocal Agreement between the two entities , an emergency is
hereby declared to exist and this ordinance , being necessary for
the preservation of the public peace, health, safety and well-
being, is hereby declared to be effective immediately upon its
passage and approval , subject to provision under Section 2 of
this ordinance.
