AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR
REPAIRS TO THE CITY ' S VAC-CON COMBINATION SEWER CLEANING
MACHINE, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES
WHEREAS, the Batesville Water Utility operates a Vac-Con
sewer cleaning machine for the purpose of repairing water lines ,
cleaning waste water lines and many other purposes , and
WHEREAS , the machine is in need of repairs which will cost
approximately Twenty Five Thousand Dollars ( $25 , 000 . 00 ) , an
amount which requires competitive bidding under Ark Code Ann
Section 14-58-303 , and
WHEREAS , competitive bidding is not feasible or practical
for the following reasons :
a. The Vac-Con Company is the only manufacturer of this
piece of equipment and the truck is unique to their design.
b. No other manufacturer or servicer is willing or able to
perform the necessary repairs .
C. The Vac-Con Company will provide a written limited
warranty on the repairs made.
d. The repairs are needed at this time to insure the
continued life of the equipment .
NOW, BE IT THEREFORE ORDAINED, that the City Council of the
City of Batesville, Arkansas finds that an exceptional situation
exists in regard to repair work on the Vac-Con combination sewer
cleaning machine, that competitive bidding is neither feasible
nor practical and that the requirement of competitive bidding for
the repair work to be done to the Vac-Con equipment is hereby
(, waived pursuant to Ark Code Ann Section 14-58-303 (B) .
• EMERGENCY CLAUSE
This ordinance being reasonably necessary for the health,
safety and convenience of the citizens of Batesville, Arkansas
and the continued life of the Vac-Con equipment , an emergency is
declared to exist and this ordinance shall be effective
immediately, from and after its passage.
