WEAVER & SON, A PARTNERSHIP I FROM R-1 TO C-1, SAID PROPERTY BEING LOCATED IN THE SE 1/4 OF SECTION 13, TOWNSHIP 13 NORTH, RANGE 6 WEST, INDEPENDENCE COUNTY, ARKANSAS AND FOR OTHER PURPOSES. WHEREAS, the City Planning Commission of .the-.City of, :.Batesville, i I Arkansas , has recommended to the Batesville City Council that the following lands lying in Independence County, Arkansas, be rezoned from R-1 to C-1 . I A part of the SE 1/4 of Section 13, Township 13 North, i Range 6 West, described thus : Commencing at the northwest corner of the SE 1/4 of Section 13 , Township 13 North, Range 6 West, thence south along the west line of I said SE 1/4 to a point where the south line of U. S. ' Highway #69 intersects the west line of said SE 1/4 of Section 13 , Township 13 North, Range 6 West, thence easterly along the south line of U. S. Highway #69 approximately 50 feet, more or less, to the east side of a 50 feet wide easement and the point of beginning of the lands herein described; thence continue easterly a distance of 435 feet to a point, the northeast corner of parcel; thence south a distance of 435 feet to a point, the south- east corner of parcel; thence west a distance of 435 feet, I more or less, to the east side of said 50 feet wide ease- ment, the southwest corner of parcel; thence north a distance of 435 feet, more or less, to the point of beginning. WHEREAS, after due notices as required by law, the Planning i Commission and the City Council has heard all persons desiring to I be heard on this question and has determined that the property' s best use is Commercial C-1 and that the property should be rezoned I under the classification of C-1 . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: i 1 (W Section 1 : That the lands described above shall be and are hereby rezoned from Residential R-1 to Commercial C-1 . Section 2 : With the provision that any development on this property will be made in accordance with the regulations governing lot sizes, set backs, and parking requirements in a C-2 zone, and with the understanding that this property will be rezoned to C-2 after hospitals and rest homes are added as a permitted use in C-2 . Section 3 : A copy of this Ordinance shall be filed by the City Clerk of the City of Batesville, Arkansas in the office of the Recorder of Deeds of this County and recorded in the Deed Record Books of Independence County. Section 4 : That the City Clerk shall cause the official zoning map of the City of Batesville, Arkansas, to note the change , effected hereby. Section 5: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 6 : IT IS HEREBY FOUND AND DECLARED THAT AN EMERGENCY EXISTS AND THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS PASSAGE FOR THE NECESSARY PROTECTION OF THE CITY' S HEALTH, SAFETY AND WELFARE.IHON PASSED and adopted this aof November, 1994 .;JI'My BARNETT, MAYOR ATTEST: HON.
