L ® ORDINANCE NO. 95.:.x' I BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AN ORDINANCE AMENDING SECTION IV, SUBSECTION IV OF THE BATESVILLE ZONING CODE AS IT RELATES TO ZONING OF NEWLY ANNEXED LANDS, AND FOR OTHER PURPOSES WHEREAS, great inconvenience has resulted from the provision that all lands annexed into the City are brought in as "R-1", and WHEREAS, the City desires to change the provisions of the Batesville Zoning Code as it relates to newly annexed lands, now; BE IT THEREFORE ORDAINED that Section IV, Subsection IV of the Batesville Zoning Code be amended to read as follows: SECTION IV GENERAL PROVISIONS IV. Zoning of Annexed Land. 1. Territory annexed to the City of Batesville shall initially be zoned R-1, Single Family Residential. 2. Thereafter, the Planning Commission shall schedule for a public hearing before the Commission not less than thirty (30) days and not more than one- hundred twenty (120) days, the matter for consideration as to the appropriate zoning of the annexed property. The Commission shall publish a notice of the time and the place of public hearing on the rezoning, which notice shall be published at least once not less than fifteen (15) days preceding the date of such IL hearing, in an official paper or a paper of general circulation in Batesville; said notice shall contain a description of the property and a statement that the property is up for proposed rezoning. The Planning Commission shall give or cause to be given such additional notice of such hearing to interested persons and organizations as it shall deem feasible and practical. 3. The Planning Commission shall conduct the public hearing on the rezoning. 4. Following the public hearing, the rezoning, if any, may be approved by a majority vote of the Planning Commission and recommended for adoption by the City Council, with reasons for such recommendations stated in writing. 5. The City Council, by majority vote, may by ordinance adopt the recommended amendment submitted by the Planning Commission or may return the proposed change in zoning classification to the Planning Commission for further study and recommendation of the Planning Commission, the City Council shall return the recommendation to the Planning Commission for further study and report. After resubmission of the recommendation, the City Council may, by majority vote, accept, reject, or modify the recommendation pertaining to the proposed change in zoning classification. - IT IS SO ORDAINED this 2."d- .."�day of.��.��4...., 1995.
