ARKANSAS AN ORDINANCE AMENDING SECTION V SUBSECTION I SUBPARAGRAPH C , AND FURTHER AMENDING SECTION V, SUBSECTION III , SUBPARAGRAPH C OF THE BATESVILLE ZONING CODE AS THESE PROVISIONS RELATE TO MINIMUM LOT SIZES UNDER CERTAIN CIRCUMSTANCES, AND FOR OTHER PURPOSES WHEREAS, SECTION V, SUBSECTION I , SUBPARAGRAPH C AND SECTION V, SUBSECTION III , SUB-PARAGRAPH C BOTH PROVIDE A MINIMUM LOT SIZE OF 7700 SQUARE FEET AND MINIMUM FRONTAGE OF 70 ' , AND WHEREAS, THESE PROVISIONS PROHIBIT CONSTRUCTION OF SINGLE FAMILY RESIDENCES IN OLDER NEIGHBORHOODS WHERE FRONTAGES AND LOT SIZES ARE OFTEN SMALLER , AND WHEREAS, THE CITY DESIRES TO ALLOW CONSTRUCTION OF SINGLE FAMILY RESIDENCES ON ALREADY PLATTED AND EXISTING LOTS WITHIN THE CITY THAT ARE SMALLER THAN THE MINIMUMS PRESCRIBED, NOW; BE IT THEREFORE ORDAINED THAT SECTION V, SUBSECTION I , SUB-PARAGRAPH C OF THE BATESVILLE ZONING CODE AND ALSO SECTION V, SUBSECTION III , SUBPARAGRAPH C OF THE BATESVILLE ZONING CODE BE AMENDED TO INCLUDE THE FOLLOWING ADDITIONAL LANGUAGE ; THE MINIMUM LOT SIZE AND FRONTAGE PROVISIONS DESCRIBED HEREIN SHALL NOT APPLY AS THEY RELATE TO THE CONSTRUCTION OR RECONSTRUCTION OF SINGLE FAMILY RESIDENCES OR LOTS THAT EXIST AND ARE PLATTED WITHIN THE CITY AT THE TIME OF PASSAGE OF THIS ORDINANCE , PROVIDED THAT THE LOTS WERE FORMERLY USED o �r ® FOR SINGLE FAMILY RESIDENTIAL PROPOSES, AND FURTHER PROVIDED THAT ONLY SINGLE FAMILY RESIDENTIAL STRUCTURES SHALL BE CONSTRUCTED OR RECONSTRUCTED ON SUCH LOTS , ALL OTHER PROVISIONS OF THIS CODE , INCLUDING SET BACK REQUIREMENT, WILL REMAIN IN FULL FORCE AND EFFECT , EMERGENCY CLAUSE THIS ORDINANCE BEING NECESSARY TO THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE OF THE CITIZENS OF BATESVILLE , AN EMERGENCY IS DECLARED TO EXIST AND THIS ORDINANCE SHALL TAKE EFFECT AND BE ENFORCED FROM AND AFTER ITS PASSAGE .
