AN ORDINANCE REZONING A TRACT OF LAND BEING, Lots 3 and
8 and the East half of Lots 2 and 9, Block 48, School Addition to the City
of Batesville, Independence, Arkansas, R-2 Residential to C-2 Commercial.
WHEREAS, the owners of a tract of land being, Lots 3 and 8 and the
East half of Lots 2 and 9, Block 48, School Addition to the City of
Batesville, Independence, Arkansas, have requested the rezoning of said
Lots from R-2 residential to C-2 Commercial and have made application
for said rezoning in the proper manner; and
WHEREAS, public hearings have been held by the Planning Commission
for the City of Batesville after proper notice having been published for the
time and in the manner required by law; and
WHEREAS, the City Council for the City of Batesville has received
reports and recommendations from the Planning Commission and after due
"o' notice as required by law, the council has heard all persons desiring to be
heard on the question and has determined that the property's best use is
commercial and that it should be rezoned C-2 and that other property
owners in the area will not be adversely affected by the rezoning and that
the general public interest and welfare will not be adversely affected by
said rezoning.
NOW THEREFORE, BE IT NOW ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BATESVILLE:
(1) Lots 3 and 8 and the East half of Lots 2 and 9, Block 48, School
Addition to the City of Batesville, Independence, Arkansas , should be,
and hereby are rezoned to the classification of C-2 commercial;
., (2) That this ordinance should be published one time in a newspaper
having general circulation in Independence County, Arkansas.
(3) That a copy of the ordinance duly filed by the City Clerk shall be
filed with the Recorder of the County and recorded in the deed records of
the County.

(4) EMERGENCY CLAUSE: There is an immediate need for the prompt
passage of this ordinance because the rezoning of this property is necessary

for consistancy of the commercial classification and quality and maintenance
of the neighborhood and its surroundings; therefore an emergency exists
and this ordinance shall take effect and be enforced from and after its
passage, approval and publication.
