HomeMy WebLinkAbout1983-07-01 .. 0 ORDINANCE # 8 3 -- 7 - ® AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING ON THE PURCHASE OF A USED MOBILE HOME TO BE PLACED WITH THE BATESVILLE PARKS AND RECREATION FACILITIES , DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS , Section Five (5) of Act 28 of 1959 as amended by Section One (1) of Act 154 of 1979 provides that the City Council , may, by ordinance , waive the requirements of competitive bidding in exceptional situations where the bidding process is deemed not to be feasible or practical; and, WHEREAS , the City Council desires and the City is in need of one used mobile home to be placed with the City recreational facilities and each used mobile home , having characteristics of its own, and not subject to any type of specifications , the City Council finds that competitive bidding would not be feasible and is not practical and finds that the City will be able to negotiate a better price if the bidding procedure is not adhered to. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE , ARKANSAS , AS FOLLOWS : Section 1 : That pursuant to Section 5 of Act 28 of 1959 as amended by Section 1 of Act 154 of 1979 , as codified in the Arkansas Statutes as Ark. Stat. Ann. § 19-4425 the requirement • of competitive bidding is hereby waived and the purchase of one used mobile home to be placed on parks and recreation property. Section 2 : That the City Council finds that this is an exceptional situation warranting waiver of bidding due to the no"feasibility and nonpracticality of bidding on a used mobile home due to the fact that each used mobile home has particular characteristics unique to itself and not, in this area , subject to bidding by specifications and the City Council finds that the City will be able to make a better financial deal without following the bid procedure. Section 3 : EMERGENCY CLAUSE : That the City Council finds that the City may purchase a mobile home at a substantial savings if the bid procedure is not followed; that said savings is in the best interest of the City of Batesville; that the City parks and recreation property is in immediate need of a mobile home and this ordinance is necessary for the promotion of the public ' s health , safety and general welfare.
