AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING ON
THE PURCHASE OF INSURANCE, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.

WHEREAS, the City now has in effect certain insurance with
WHITE RIVER INSURANCE AGENCY
and the City Council finds that there will be a substantial
savings by renewing said insurance policy rather than obtaining
insurance from other companies; and

WHEREAS , in the past, the Batesville Insurance Association has
submitted only one bid per year with the bid being exchanged
from one insurance company to the other; and
WHEREAS, the City Council finds that insurance cannot be purchased
any cheaper and that the renewal will be at a savings which will
be in the best interest of the City of Batesville and its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BATESVILLE, ARKANSAS, AS FOLLOWS :
Section 1 : That pursuant to Ark. Stat. Ann. 9 19-4425 the
requirements of competitive bidding are hereby waived in the
. purchase of insurance for the City of Batesville.
Section 2 : That the City Council finds that this is an
exceptional situation warranting waiver of bidding due to the
nonfeasibility and nonpracticality of bidding on such item.
Section 3: EMERGENCY CLAUSE: That this ordinance would be in
the best interest of the public ' s health, safety and general
welfare and the timeliness of said purchase being of utmost
importance and competitive bidding not being feasible and
nonpractical and an emergency is hereby declared and this
ordinance should be in full force and effect as of the date
of its passage.
