AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE #966 AS FOUND
IN SECTION 2. 20 . 08 OF THE BATESVILLE MUNICIPAL CODE; LEVING
COURT COSTS FOR CRIMINAL JUSTICE FUND TO DEFRAY EXPENSES OF
INCARCERATING CITY PRISONERS IN THE COUNTY JAIL; DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES :
BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS , AS FOLLOWS :
Section 1 : Section one of Ordinance #966 as found as paragraph
one of section 2 . 20 . 08 in the Batesville Municipal Code is
hereby amended to read as follows:
"1 . Criminal Justice Fund - An additional five dollars
($5. 00) is hereby levied and shall be collected by the
Batesville Municipal Court as court costs from each
defendant upon a plea of guilty, nolo contendre ,
forfeiture of bond or determination of guilt for
all misdemeanors and traffic offenses brought before
said court. "
Section 2 : EMERGENCY CLAUSE - The cost of keeping incarcerated
prisoners is ever increasing and such costs should be born by
• the persons violating certain laws in the City of Batesville
and the City Council finds that an emergency exists due to the
increase in expenses , therefore , an emergency is hereby declared
to exist and this ordinance being necessary for the preservation
of public peace, health and safety shall be in full force and
effect from and after its passage and approval .
