AN ORDINANCE REZONING LOTS THIRTEEN (13) AND FOURTEEN
(14) OF BLOCK SEVENTY-SIX (76) OF MAXFIELD'S THIRD EASTERN
ADDITION TO THE CITY OF BATESVILLE, INDEPENDENCE COUNTY,
ARKANSAS, FROM R-2 RESIDENTIAL TO C-2 COMMERCIAL.
WHEREAS, the owners of a tract of land, being all of Lots
Thirteen (13) and Fourteen (14) of Block Seventy-Six (76) of
Maxfield's Third Eastern Addition to the City of Batesville,
Independence County, Arkansas, have requested the rezoning of
said lots from R-2 residential to C-2 commercial and have made
application for said rezoning in the proper manner; and
® WHEREAS, public hearings have been held by the Planning
Commission for the City of Batesville after proper notice having
been published for the time and in the manner required by law;
and
WHEREAS, the City Council for the City of Batesville has
received reports and recommendations from the Planning Commission
and after due notice as required by law, the Council has heard
all persons desiring to be heard on the question and has determined
that the property' s best use is commercial and that it should
be rezoned to C-2 and that other property owners in the area will
not be adversely affected by the rezoning and that the general
public interest and welfare will not be adversely affected by j
said rezoning and in fact will be enhanced.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BATESVILLE:
(1) A tract of land being all of Lots Thirteen (13) and
Fourteen (14) of Block Seventy-Six (76) of Maxfield' s Third
Eastern Addition to the City of Batesville, Independence County, '
Arkansas, should be, and it hereby is , rezoned to the
classification of C-2 Commercial;
• (2) That this ordinance should be published one time in a
newspaper having general circulation in Independence County,
Arkansas;
(3) That a copy of the ordinance duly filed by the City
Clerk shall be filed with the Recorder of the County and recorded
in the Deed Records of the county.

(4) That due to the passage of time during the original
appeal of this matter and due to the necessity of a storage
building being immediately built, it is hereby declared that an
emergency exists and that this ordinance shall be in full force
and effect from and after its passage .
