BE IT ORDAINED BY THE CITY COUNCIL OF THF CITY OF BATFSVILLE, ARKANSAS , AS FOLLOWS : Section 1: That pursuant to Section Five (5) of Act 28 of 1959 as amended by Section One (1) of Act 154 of 1979 , as codified in the Arkansas Statutes as Ark. Stat . Ann. Section 19-4425 the requirement of competitive bidding is hereby waived on the purchase of computer software. Section 2 : That the City Council finds that this is an ex- ceptional situation warranting waiver of bidding due to the nonfeasibility and nonpracticality of bidding on computer software since said software must be cohesive with date pro- cessing hardware. Section 3 : EMERGENCY CLAUSE: This purchase would be in the • best interest of the public ' s health, safety and general wel- fare and the timeliness of said purchase being of the utmost importance and competitive bidding being nonfeasible and non- practical an emergency is hereby declared and this ordinance shall be in full force and effect as of the date of its pass- age. McCuin, President School Data Service, Inc . 770 St. Louis Street Batesville, Arkansas 72501 December 9, 1983 • • Software Proposal School Data Service, Inc . proposes to provide software for a micro-computer system, including, installation of software, as well as training and on-going suport . I . Software A. Scope and assumptions of the proposal School Data Service proposes to grant the City of Batesville a nontransferable and nonexclusive license to use its software and does not propose to sell or transfer title to its software in any way. All copyright , patent , trade secret and other intellectual and proprietary rights therein, will remain the valuable property of School Data Service, Inc . Moreover , the city shall safeguard all copies of the licensed software against unauthorized disclosure and copying . The terms of this license agreement shall be based upon a one-time payment the amount of which is found elsewhere in this proposal , and grants to the city the right to use the software described in this prcDosal for as long as they desire. B. Functions of the user Software Te proposed user software will provide for the following : 1 . Provide quick assess to all information such that a person not familiar with the computer could easily use the software. This includes adding, deleting , searching for , or changing information. 2 . Print out all checks , including payroll , clearing , and cash kinvoiced bills) . 3 . Print out the following monthly reports : a . Monthly payroll report which calculates matching funds automatically. b . A cash ledger providing a current balance of all funds by fund code. c . A cash journal providing an itemized report of all transactions for the month by fund code, function, object, source of funds , and department . d. A monthly expenditure report providing a summary of expenditures for the current month, year-to-date, and balance for each budgeted line item, as well as percentages . e . A revenue report providing a summary of revenue received by fund code and account code, as well as percentages . f . A listing of all transactions by warrant number sequence in order to balance with the bank statement . g . A printout of payroll information by employees listing all checks and corresponding information. h. Personnel records . i . Vendor file for accounts payable . j . Fixed asset accounting k. Electronic files . 1 . W-2 Forms . C . Software Maintenance School Data Service will use its best efforts to insure that the licensed software will be free from defects . Should sucL-1 defects be discovered in the licensed software, School Data Service will use its best efforts to correct such defects without charge to the city . Federal and State withholding tax tables will be revised when applicable. This service will be furnished at no cost to the city for 36 months . D. Software Modification All modifications to the licensed software must be made by School Data Service employees . Any modifications to the licensed software requested by the city that is not required to cure defects is billable to the cites based on School Data Service' s hourly rates in effect for its personnel , plus reimbursement for reasonable travel and expenses if applicable. II . Support A. School Data Service will provide technical support to the city on questions relating to the software. B. School Data Service will provide installation of all software at no extra charge to the city, if the software is installed on IBM Personal Computers and a Novell S-20 Network. Following installation, School Data Service will use its best efforts to provide all needed on site and telephone a-csistance to the city. III .
