AN ORDINANCE AMENDING THE CITY OF BATFSVILLE ZONING CODE SECTION
III - II; ADDING AS AN ACCESSORY USE SATELLITE TELEVISION
RECEIVER. DISCS , AND FOR OTHER PURPOSES :
WHEREAS, one purpose of a zoning code is to protect the character
and stability of residential areas and conserve and protect the
value of property and conserve and protect the aesthetics of
the community, and;
WHFREAS, the Batesville City Zoning Ordinance does not now in-
clude any provision pertaining to satellite television receiver
discs , and;
WHEREAS, there have been an increase in number of satellite
television receiver discs being purchased and used within the
City and placed upon or near lot lines , in front yards and
wherever a property owner may desire without any protection
to neighboring property, and;
WHEREAS, due to the size and aesthetics of a satellite television '
receiver disc, among other things , the Batesville Planning
Commission has recommended that it be included in the Batesville
City Zoning Ordinance as an accessory use due to its similarity
• to items now included therein.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS :
Section 1: That Section III-II of the Batesville Municipal
Zoning Code, defining accessory use, be amended to include i
satellite television receiver discs , this amendment not changing
any other portion of the definition of accessory use but only
adding the following to the list of items now contained therein :
(j ) Satellite Television Receiver Discs , ground-
mounted or mobile. Said structures are defined as
devices commonly parabolic in shape, mounted at a
fixed point on the ground, or upon mobile vehicles ,
for the purpose of capturing television signals
transmitted via satellite communication facilities
and serving the same or similar function as the
common television antenna.
Section 2 : That no other portion of the zoning ordinance be
changed other than the adding of the above stated subsection.
Further, if any part or parts of this ordinance shall be de-
clared unconstitutional or otherwise unlawful by any court of
competent jurisdiction, then that part or parts of said ord-
inance declared to be unconstitutional or otherwise unlawful
shall be severed from this ordinance and all other portions of
this ordinance shall remain in full force and effect as if
those portions declared unlawful or unconstitutional were never
a part thereof.
