HomeMy WebLinkAbout1984-03-02 - i (W • ORDINANCE 'NM. -j - Z AN ORDINANCE REDISTRICTING THE TIARDS OF THE CITY OF BATESVILLE, ARKANSAS , CHANGING BOU-MMARY LINES THEREOF , AND PROVIDING FOR AUTOMATIC EXP.,'?,NSION OF THOSE WARDS TO ADJACE*.T UNINCORPORATED AREAS IF ANNEXATION SHOULD OCCUR; DECLARING All E''?ERGET` CY AND OTHER PURPOSES: 1HEREAS , Act No. 253 of the 1983 Arkansas General Assemble, as codified in Ark. Stat. Ann. § 19-1005 , gives the City Council the authority to redistrict and change ward boundary lines , and; WHEREAS , the City Council of the City of Batesville, Arkansas has determined after due consideration, notice to the public and public hearings , that redistricting or changing of the ward boundary lines are necessary and further determine that the people of the City of Batesville can best be served b;% such redistricting or changing of ward boundary lines , and; WHEREAS , said redistricting would provide for equalization o= populization in the various wards and allow for expansion in each ward. BE IT ORDAINED BY THE CITY COUNCII, OF THE CITY OF BATESVILLE, • ARKANSAS: Section 1 : That the City of Batesville shall be divided into four (4) wards. That said wards shall be designated respectively ; as Ward 1 , Ward 2 , "s-'ard 3 and Ward 4 . The respective wards shall i consist of the areas designated, set forth and described on the official ward map of the City, a copy of which is attached hereto, marked EXHIBIT "A" and made a part hereof as though fully set out herein word for word, paragraph for paragraph , boundary for boundary, said _nap to be filed and maintained in the office of the City Clerk for the City of Batesville. Section 2 : The City Council shall , upon accepting any unincorpor-I ated lands into the Cite of Batesville shall at the same time ' designate which ward the newly added property will become a part of, taking into consideration natural boundaries and logical extensions of existing wards , equalization of population, actual or potential growth patterns of all wards , and other matters relevant to that decision; Once placed within a ,-.!ard the City Clerk shall then take the necessary and appropriate steps to include said area within the designated ward on the official map. Section 3 : If any part or parts of this ordinance shall be declared unconstitutional or otherwise unlawful by any Court of competent jurisdiction, then that part or parts of said ordinance declared to be unconstitutional or otherwise unlawful shall be severed from this ordinance and all other portions of this ordinance shall remain in full force and effect as if those portions declared unconstitutional or unlawful were never a part thereof. Section 4 : That a'_1 ordinances or parts of ordinances in conlic herewith are hereby repealed. Section 5: EMERGENCY CLAUSE: Whereas , the City Council finds that the Cite wards as now districted are not comparatively equal in population and further finds that some wards , as presentl'17 districted, have little if any area for expansion_ and, whereas , • the Cite Council finds that it would be in the best interest of the citizens of the CitN7 of Batesville to have more equally populated wards and in the citizen ' s best interest to have wards equally capable of expansion.; and, further, the City Council finds that ward redistricting_ should be done as soon as possible , in order for the citizens of Batesville to have equal representation in the impending elections , this ordinance is necessary for the preservation of the nublic ' s welfare and an emergency is hereby declared to exist anc this ordinance shall be in full force and ef"ect from and after its nassac-e. r � Passed and approved this day of � , 1984. i J i!?
