AN ORDINANCE VACATING AND ABANDONING ADLER STREET
WHEREAS , a petition was duly filed with the City Council
for Batesville, Arkansas on March 19 , 1984 , as amended by a
petition filed March 26 , 1984, asking the City Council to vacate
and abandon Adler Street in the City of Batesville, Arkansas ,
said street being hereinafter more specifically described ; and
WHEREAS , after due notice as required by law, the Council
has , at the time and place mentioned in the notice, heard all
persons desiring to be heard on the question and has ascertained:
(1) That Adler Street has heretofore been dedicated to the
public use as a street hereinafter described;
• (2) That all of the owners of the property abutting upon
Adler Street have consented to such vacation and abandonment;
(3) That said street has not been actually used by the public
generally for a period of at least five (5) years subsequent to
the filing of said plat of dedication, and , in fact , has never
been opened to use by the general public since its dedication.
(4) That the public interest and welfare will not be adversel
affected by the vacation and abandonment of said street.
(5) That Adler Street is not required for any corporate
purpose; and
(6) That no public inconvenience will result from said
closing .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS :
Section 1. The City of Batesville, Arkansas , hereby releases,
vacates and abandons all of its rights , together with the rights
of the public generally, in and to Adler Street in Batesville,
Independence County, Arkansas , as hereinafter described :
(a) Adler Street should be and hereby is described
as all of that portion of Adler Street in Batesville,
4 Independence County, Arkansas , bounded on the north by
Block 6 of Ball ' s Second Addition, City of Batesville,
Arkansas , and bounded on the south by Block 5 of Ball' s
Second Addition, City of Batesville, Arkansas .

(b) A copy of said plat of Ball ' s Second Addition
is found in Deed Book V-7 , page 552A of the records
of Independence County, Arkansas .
Section 2 . Absolute ownership of Adler Street as above
described shall vest in the owners of the property abutting
Adler Street .
Section 3 . A copy of the Ordinance duly certified by the
City Clerk shall be filed in the Office of the Recorder of
Batesville, Independence County, Arkansas , in the deed records
of Independence County, Arkansas .
Section 4 . This Ordinance shall take effect and be in force
from and after its passage.
