ORDINANCE NO. '35- 7 -Z
- AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING IN .
SECURING ENGINEERING SERVICES BY THE BA's' SVILLE MUNICIPAL AIRPORT
COMMISSION FOR AN AIRPORT MASTER PLAN STUDY; DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS AS FOLLOWS:
SECTION 1 : That pursuant to Section 5 of Act 28 of 1959 as amended
by Section 1 of Act 154 of 1979 , as codified in the Arkansas
Statutes as ARK. Stat. Ann o 19-4425 the requirement of competitive
bidding is hereby waived in the purchase of eng,.neering services
by the Batesville Municipal Airport Commission in Order to obtain
an Airport Master Plan Study.
SECTION 2 : That the Batesville City Council finds that this is an
exceptional situation warranting waiver of bidding due to the
nonfeasibility and nonpracticality of bidding on professional
services such as engineering services.
SECTION 3 : EMERGENCY CLAUSE: This purchase would be in the best
interest of the public ' s health, safety and general welfare and
the timeliness of the securing of engineering services for
development of an Airport Master Plan Study are of utmost importance
and competitive bidding not being feasible and not being practical
® and further since the Airport Commission has already conducted a
study of available engineers conducting work of this type and
have determined they have secured the best, an emergency is hereby
declared and this Ordinance shall be in full force and effect as
of the date of i-L'-s passage. I
