AN ORDINANCE APPROVING AND ACCEPTING THE ANNEXATION TO THE CITY OF BATESVILLE , ARKANSAS OF A TRACT OF LAND IN THE SOUTH- WEST QUARTER OF SECTION 15 AND THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 22 , TOWNSHIP 13 NORTH, RANGE 6 WEST, INDEPEN- DENCE COUNTY , ARKANSAS. WHEREAS, the County Court of Independence County, Arkansas , entered its order dated ,lune 11 , 1985 , upon the petition of the Board of Directors of the Batesville Country Club, the sole owner of the lands to be annexed, after due notice of hearing on said petition in the time and in the manner prescribed by law, ordering the annexation of the following described lands located in Independence County, • Arkansas , to-wit: A Part of the Southwest Quarter of Section Fifteen and a part of the Northwest Quarter of the Northwest Quarter of Section Twenty-two, all in Township Thirteen North, Range Six West, described by metes and bounds thus : Commencing at the Quarter Section corner between Section Fifteen and Sixteen in said township and range, and running thence East seven hundred feet, thence South three hundred ninety-six1to place of beginning of the land herein TSA thence South Five degrees East three hundred fifteen feet; thence South Twenty-two degrees West five hundred feet; thence South one degree and forty-five minutes West four hundred fifty feet; thence South seventeen degrees and thirty minutes West two hundred fifty feet; thence South thirty-two degrees and thirty minutes West two hundred feet; thence South nineteen degrees and forty-five minutes West Four hundred feet; thence south three degrees East two hundred fifty-four feet to the Northwest corner of Section 22 ; thence South along West side of Section 22 a distance of four hundred fifty feet; thence North eighty five degrees East six hundred forty-one feet; thence North nine degrees and thirty minues East one hundred eleven feet; thence North thirty-one degrees and forty-five minutes East one hundred eighty-six feet . thence North twelve degrees and fifteen minutes East one hundred seventy-six feet; thence North four degrees East two hundred feet; thence North twenty-two degrees and thirty minutes East one hundred seventy-four feet ; thence North fifty-five degrees and thirty minutes East three hundred feet; thence North seventy-seven degrees and fifteen minutes East one hundred fifty-three feet; thence North fifty-two degrees and thirty minutes East two hundred fifteen feet; thence North fifty-seven degrees East one hundred seventy-two feet; thence North forty-five degrees East two hundred eighty feet; thence North fourteen degrees and thirty minutes West two hundred thirty-four feet; thence North seventeen degrees East two hundred eighty-nine feet ; thence North sixty-nine degrees and fifteen • minutes East one hundred twelve feet; thence North nineteen degrees 644 seven hundred ninety-six feet; thence South eighty five degrees West one thousand one hundred ninety feet; thence North five degrees West one hundred seventy five feet; thence South eighty-five degrees West four hundred feet to the place of beginning, containing a total of seventy-four acres , more or less . LESS AND EXCEPT HOWEVER: All that part of the foregoing lands which lie North of the following described line: Begin at a point that is evidenced by a steel stake set in mortar and plastic pipe that is 690 . 0 feet East and 402 feet South of the West Quarter Section Corner of Section 15 , Township 13 North, Range 6 West; thence run South 89 degrees 01 minute East 223 feet to the point of beginning; thence continue South 89 degrees 01 minute East 177 feet to a point; thence South 00 degree 53 minutes West 218 . 3 feet to a point; thence South 88 degrees 17 minutes East 543 . 8 feet to a point; thence North 00 degree 53 minutes East 210 .0 feet to a point; thence South 88 degrees 17 minutes East 426 . 0 feet to a point; thence South 00 degree 53 minutes West 210 feet to a point; thence South 88 degrees 17 minutes East 277 .4 feet to the end of the described line WHEREAS, more than thirty days have elapsed since the entry of said order by the County Court of Independence County, Arkansas, and no person, firm or corporation has instituted any proceeding in the Circuit Court of Independence County, Arkansas , or elsewhere, to prevent such annexation, and no protestants have appeared and no notice given to the authorities of the City of Batesville, Arkansas , of any attempt to vacate, review, set aside or appeal from said order of the County Court; and WHEREAS, said above described lands are contiguous to and adjoin the City of Batesville, Arkansas; NOW, THEREFORE , BE IT ORDAINED by the City Council of the City of Batesville, Arkansas: Section 1 : That the City of Batesville, Arkansas,acting by and through the City Council , does hereby approve the annexation of, and does hereby accept and make a party of the incorporated area of the City of Batesville, Arkansas, all of the lands described herein above; and that said lands be and are hereby assigned and attached to Ward —f of said City. Section 2 : It is further ordered that when two copies of the entire proceedings in the Independence County Court concerning this annexation have been prepared and duly filed ® by the Independence County Clerk , one copy of said proceedings shall be delivered to and filed with the Secretary of State of the State of Arkansas , pursuant to Arkansas Stat . Section 19-305 . PASSED this day of July, 1985 .
