HomeMy WebLinkAbout1985-11-01 ORDINANCE # ` ' � E AN ORDINANCE ACCEPTING AND CONFIRMING THE DEDICATION OF A CERTAIN ® TRACT OF LAND OWNED BY MALCOLM MOORE AND EDITH MOORE, HUSBAND AND WIFE, JOHN NORMAN HARKEY AND WILLA HARKEY, HUSBAND AND WIFE, AND FLYWAYS DEVELOPMENT COMPANY, A.J.V. , AS A PUBLIC STREET AND FOR OTHER PURPOSES. NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: Section 1 : That the dedication of a certain tract of land deeded to the City of Batesville by Malcolm Moore and Edith Moore, husband and wife, John Norman Harkey and Willa Harkey, husband and wife, and Flyways Development Company, A.J.V. for street purposes is hereby accepted and confirmed and the same shall hereinafter be open to public use and shall be a public street unless hereinafter closed pursuant to Arkansas law; that said tract of land is more particularly described as follows : A tract of land being a part of the NW 4 of the NE 4 and a part of the NE4 of the NW4 of Section 9 in Township 13 North, Range 6 West of the 5th Principal Meridian in the City of Batesville, ' Independence County, Arkansas more particularly described as follows : Commencing at the Quarter Section Corner to Sections 9 and 4 in said Township 13 North, Range 6 West; thence run S 04000 ' E a distance of 50 . 0 feet to the South R/W line of Arkansas Highway 25 ; thence run N 86000 ' E along said South R/W line, a distance of 226 . 0 feet; thence run S 04000 ' E, a distance of 300 . 00 feet; thence run N 86026 ' E, a distance of 148 . 15 feet to the Point of Beginning (POB) ; thence run N 86026 ' E a distance of 62 . 25 feet to the West R/W line of U.S. Highway 167 ; thence run along said West R/W line as follows : S 330 W, 499 . 0 feet; S 28053 'W, 198 . 00 feet; S 330 W, 283 . 00 feet; thence leaving said West R/W line run N 570 W, a distance of 50 . 00 feet; thence run N 33° E, a distance of 281 . 20 feet; thence run N 28053 ' E, a distance of 198 . 00 feet; thence run N 330 E, a distance of 463 . 71 feet to the Point of Beginning.
