AN ORDINANCE REZONING CERTAIN PROPERTY IN
THE CITY OF BATESVILLE, ARKANSAS LYING IN
THE SOUTHWEST QUARTER OF SECTION 15 AND THE
NORTHWEST QUARTER OF THE NORTHWEST QUARTER
OF SECTION 22 , TOWNSHIP 13 NORTH, RANGE 6
WEST, INDEPENDENCE COUNTY, ARKANSAS.
WHEREAS, the Batesville Board of Zoning Adjustment has
conducted a public hearing on the Petition of the Batesville
Country Club for the rezoning of certain property lying in
the City of Batesville, Independence County, Arkansas , and
the City Board of Zoning Adjustment has recommended to the
Batesville City Council that the following described lands
lying in Independence County, Arkansas , be rezoned from
Residential R-1 to Residential R-2 :
LYING IN THE SOUTHWEST QUARTER OF SECTION 15
AND THE NORTHWEST QUARTER OF THE NORTHWEST
QUARTER OF SECTION 22 , TOWNSHIP 13 NORTH,
RANGE 6 WEST, INDEPENDENCE COUNTY, ARKANSAS.
WHEREAS, after due notices as required by law, the
Board of Zoning Adjustment has heard all persons desiring to
be heard on the question and has determined that the
property' s best use is for uses compatible with those under
the classification Residential R-2 . That other property
owners in the area will not be adversely affected by the
rezoning and that the general public interest and welfare
will not be adversely affected by said rezoning.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Batesville, Arkansas :
1 . That the following described lands lying in
Independence County, Arkansas shall be rezoned under the
classification Residential R-2:
A part of the Southwest Quarter of Section 15
and a part of the Northwest Quarter of the
Northwest Quarter of Section 22 , all in
Township 13 North, Range 6 West , described by
metes and bounds thus : Commencing at the
Quarter Section corner between Sections 15
and 16 in said township and range, and
running thence East 700 feet , thence South
396 feet to place of beginning of the land
herein rezoned; thence South 5 degrees East
315 feet ; thence South 22 degrees West 500
feet ; thence South 1 degree and 45 minutes
West 450 feet ; thence South 17 degrees and 30
minutes West 250 feet; thence South 32
degrees and 30 minutes West 200 feet ; thence

South 19 degrees and 45 minutes West 400
feet; thence South 3 degrees East 254 feet to
the Northwest corner of Section 22 ; thence
South along West side of Section 22 a
distance of 450 feet ; thence North 85 degrees
East 641 feet ; thence North 9 degrees and 30
minutes East 111 feet ; thence North 31
degrees and 45 minutes East 186 feet ; thence
North 12 degrees and 15 minutes East 176
feet; thence North 4 degrees East 200 feet ;
thence North 22 degrees and 30 minutes East
174 feet ; thence North 55 degrees and 30
minutes East 300 feet ; thence North 77
degrees and 15 minutes East 153 feet ; thence
North 52 degrees and 30 minutes East 215
feet ; thence North 57 degrees East 172 feet;
thence North 45 degrees East 280 feet; thence

thence North 69 degrees and 15 minutes East

thence South 85 degrees West 400 feet to the
place of beginning, containing a total of 74
acres, more or less .
LESS AND EXCEPT HOWEVER: All that part of
the foregoing lands which lie North of the
following described line :
Begin at a point that is evidenced by a steel
stake set in mortar and plastic pipe that is
690 . 0 feet East and 402 feet South of the
West Quarter Section Corner of Section 15 ,
Township 13 North, Range 6 West; thence run
South 89 degrees 01 minute East 223 feet to
the point of beginning; thence continue South
89 degrees 01 minute East 177 feet to a
point; thence South 00 degree 53 minutes West
218 . 3 feet to a point; thence South 88
degrees 17 minutes East 543 . 8 feet to a
point; thence North 00 degree 53 minutes East
210 . 0 feet to a point; thence South 88
degrees 17 minutes East 426 . 0 feet to a
point; thence South 00 degree 53 minutes West
210 feet to a point; thence South 88 degrees
17 minutes East 277 . 4 feet to the end of the
described line .
2 . A copy of the ordinance duly filed by the City
Clerk shall be filed in the Office of the Recorder of the
county and recorded inthe Deed Records of the county.
