HomeMy WebLinkAbout1986-01-05 4 ORDINANCE NO. i " J AN ORDINANCE REZONING CERTAIN PROPERTY OWNED BY FREEMAN MOBLEY, REEKIE GARDNER AND RICKY FLETCHER, FROM C-2 TO R-1, SAID PROPERTY BEING LOCATED IN SECTION 14 , TOWNSHIP 13 NORTH, RANGE 6 WEST, INDEPENDENCE COUNTY, ARKANSAS; AND FOR OTHER PURPOSES. WHEREAS, the City Planning Commission of the City of Batesville, Arkansas, has recommended to the Batesville City Council that the following lands lying in Independence County, Arkansas, be rezoned from Commercial-2 to R-1 . A tract of land being a part of the North Half of Section Fourteen in Township Thirteen North and Range Six West of the Fifth Principal Meridian, in Independence County, Arkansas, more particularly described as follows : Commencing at the Southwest Corner of said North Half , thence South 89°20 ' 44" East �r along the South line of said North Half , a distance of 3 , 026 . 72 feet; thence North 00°39118" East, a distance of 170 . 00 feet to the Point of Beginning, thence North 89°20144" West, a distance of 70 . 00 feet; thence North 51018107 " West, a distance of 202 . 71 feet; thence North 08°33 ' 57" East a distance of 57 . 73 feet to a point of the South Right of Way Line of Arkansas State Highway 69 ; thence begin- ning on South 80°22 ' 08" E on a curve to the right having a 1 . 577 . 02 foot radius along said South Right-of-Way Line, a curve distance of 268 . 48 feet; thence South 18051156" West a distance of 123 . 85 feet to the Point of Beginning. Contain- ing 0 . 64 Acres, more or less . ALSO: A tract of land being a part of the North Half of Section 14 in Township 13 North and Range 6 West of the Fifth Principal Meridian (Ni-, Sec. 14 , T13N, R6W, 5th P.M. ) in Independence County, Arkansas, (W more particularly described as follows : Commencing at the southwest corner of said North Half ; thence south 89020 ' 44" East along the South line of said North Half , a distance of 2 , 866 . 72 feet; thence North 00039116" East a distance of 80 . 00 feet to the point of beginning; thence North 89°20 ' 44" West a distance of 80 . 00 feet; thence North 00039 ' 16" East a distance of 140 . 39 feet; thence North 08033 ' 57" East a distance of 75 . 25 feet; thence South 51018 ' 07" East a distance of 202 .71 feet; thence South 45°39116" West a distance of 127 . 28 feet to the Point of Beginning, containing 0. 51 acres, more or less . ALSO: A tract of land being a part of the North Half of Section 14 in Township 13 North and Range 6 West of the Fifth Principal Meridian (N2r Sec. 14 , T13N, R6W, 5th P.M. ) in Independence County, Arkansas, more particularly described as follows : Commencing at the southwest corner of said North Half ; thence South 89020 ' 44" East along the South line of said North Half, a distance of 2 , 866 . 72 i feet to the point of beginning; thence North 00°39 ' 16" East a distance of 80 . 00 feet; thence North 45039 ' 16" East a distance of 127 . 28 feet; thence South 89°20144" East a distance of 70 . 00 feet; thence South 00039 ' 16" West a distance of 170 . 00 feet; thence North 89°20 ' 44" West a distance of 160 . 00 feet to the point of beginning, containing 0 . 53 acres, more or less . WHEREAS, after due notices as required by law, the Planning Commission and the City Council has heard all persons desiring to be heard on this question and has determined that the property' s best use is residential R-1 and that the property should be rezoned under the classification of R-1. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: Section 1 : That the lands described above shall be and are hereby rezoned from Commercial C-2 to Residential R-1 . Section 2 : A copy of this Ordinance shall be filed by the City Clerk of the City of Batesville, Arkansas in the office of the Recorder of Deeds of this County and recorded in the Deed Record Books of Independence County. Section 3 : That the City Clerk shall cause the official zoning map of the City of Batesville, Arkansas, to note the • change effected hereby. Section 4 : That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 5 : IT IS HEREBY FOUND AND DECLARED THAT AN EMERGENCY EXISTS AND THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS PASSAGE FOR THE NECESSARY PROTECTION OF THE CITY' S HEALTH, SAFETY AND WELFARE.
