ORDINANCE
AN ORDINANCE AMENDING SECTION 10 . 28 . 01 OF THE BATESVILLE MUNICIPAL
CODE, ABOLISHING THE REQUIREMENTS THAT A DEPOSIT BE MADE FOR
RESIDENTIAL GARBAGE SERVICE, DECLARING AN EMERGENCY AND FOR OTHER
.PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS, AS FOLLOWS:
Section 1 : That Section 10 . 28 . 01 of the Batesville Municipal
Code requiring a deposit to be made for residential garbage
service is hereby amended to provide that there shall no longer
be a requirement for deposit for residential garbage service and
said Section 10 . 23 . 01 is hereby amended to provide as follows :
10 . 28 . 01 Deposit Required : From and after the passage
of this Ordinance a deposit of Twenty-Five Dollars
( $25 . 00 ) shall be required for water service, Twenty-
Five Dollars ( $25 . 00 ) for sewer service and a deposit
of Twenty Dollars ( $20 . 00 ) shall be required for
garbage service. Said deposit for garbage service
shall not apply to residential users and shall apply
only to commercial/business/industrial or other non-
residential establishments . The deposit will draw
no interest. The deposit shall be made to the agency
of the City in charge of collecting the water tax,
sewer tax and garbage tax.
Section 2 : That any and all Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 3 : That this Ordinance is necessary for the public ' s
health, safety and welfare and an emergency is hereby declared to
exist and this Ordinance shall be in full force and effect from
and after the date of its passage.
