AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING CON-
4W THE BATESVILLE AVIATION COMMISSION' S PURCHASE OF A USED
LOW-FREQUENCY SPECTRUM ANALYZER; DECLARING AN EMERGENCY AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS, AS FOLLOWS :
Section l : That pursuant to Section Five ( 5 ) of Act 28 of 1959
as amended by Section One ( 1 ) of Act 154 of 1979 , as codified in
the Arkansas Statutes as Ark. Stat. Ann. §19-4425 the requirement
of competitive bidding is hereby waived concerning the purchase
of one ( 1 ) Iiewlett Packard Model #3581A Low Frequency Spectrum
Analyzer by the Batesville Aviation Commission from US Instrument
Rentals , Inc. , of Richardson, Texas .
Section 2 : That said Low Frequency Spectrum Analyzer is an item
of used merchandise and as such the City Council finds that this
is an exceptional situation warranting waiver of bidding due to
the non-feasibility and non-practicality of bidding on used equip-
ment; that the Batesville Aviation Commission has found that said
used merchandise is the particular instrument which they need and
is worth the puchase price of Three-Thousand Six-Hundred Dollars
( $3 , 600 . 00 ) .
Section 3 : EMERGENCY CLAUSE: This purchase would be in the best
interest of the public ' s health, safety and general welfare and
the timeliness of said purchase being of the utmost importance
and competitive bidding being non-feasible and non-practical and
an emergency is hereby declared to exist and this Ordinance shall
be in full force and effect from and after the date of its passage
