AN ORDINANCE REZONING CERTAIN PROPERTY OWNED BY DONNIE BRYANT AND BURNELL
iBRYANT FROM R-1 TO C-2, SAID PROPERTY BEING LOCATED IN SECTION 15, TOWNSHIP
13 NORTH, RANGE 6 WEST, INDEPENDENCE COUNTY, ARKANSAS, DECLARING AN EMER-
GENCY, AND FOR OTHER PURPOSES.
WHEREAS, the City Planning Commission of the City of Batesville, Arkansas,
has recommended to the Batesville City Council that the following described
lands lying in Independence County, Arkansas, be rezoned from Residential R-1
to Commercial C-2; and
WHEREAS, after due notices as required by law, the Planning Commission

and the City Council has heard all persons desiring to be heard on this ques-
tion and has determined that the property' s best use is Commercial C-2 and that
the property should be rezoned under the classification of C-2.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATES-
VILLE, ARKANSAS AS FOLLOWS:
Section 1: That the following described lands shall be and are hereby
rezoned from Residential R-1 to Commercial C-2:
A tract of land surveyed as part of the SE-1, of the SE-1, of
Section 15, Township 13 North, Range 6 West, described thus:
Beginning at a metal stake, the Northeast corner of the SE, of
the SE-1, of Section 15, thence N83°22' W 223.6 feet to a point
4.0 feet West of a 30 inch White Oak Tree, thence S87°16' W 29.0
feet to a metal stake, thence S02°15' E 263.0 feet to the North
Right of Way of Highway 69, thence Northeasterly along the North
Right of Way of Highway 69, 339.8 feet to the East line of the
SE-1, of the SE-1,, thence NO2°15' W 1. 55 feet to point of beginning,
containing .86 acre more or less.
Section 2: A copy of this Ordinance shall be filed by the City Clerk of
the City of Batesville, Arkansas in the office of the Recorder of Deeds of
this County and recorded in the Deed Record Books of Independence County.
Section 3: That the City Clerk shall cause the official zoning map of
® the City of Batesville, Arkansas, to note the change effected hereby.
Section 4: That all Ordinances or parts of Ordinances in conflict here-
with are hereby repealed.
Section 5: IT IS HEREBY FOUND AND DECLARED THAT AN EMERGENCY EXISTS AND
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS
PASSAGE FOR THE NECESSARY PROTECTION OF THE CITY' S HEALTH, SAFETY AND WELFARE.
PASSED and adopted this day of July, 1986.
