ORDINANCE NO. <br /> AN ORDINANCE REZONING CERTAIN PROPERTY OWNED BY C. FITZHUGH SPRAGINS, JOHN <br /> D. SPRAGINS, JOEL F. SPRAGINS AND MARY SPRAGINS KUYKENDALL FROM R-2 TO C-2, <br /> SAID PROPERTY BEING LOCATED IN SECTION 16, TOWNSHIP 13 NORTH, RANGE 6 WEST, <br /> INDEPENDENCE COUNTY, ARKANSAS. <br /> WHEREAS, the City Planning Commission of the City of Batesville, Arkansas, <br /> has recommended to the Batesville City Council that the following described <br /> lands lying in Independence County, Arkansas, re rezoned from Residential R-2 <br /> to Commercial C-2; and <br /> WHEREAS, after due notices as required by law, the Planning Commission and <br /> the City Council has heard all persons desiring to be heard on this question <br /> and has determined that the property' s best use is Commercial C-2 and that the <br /> property should be rezoned under the Classification of C-2. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATES- <br /> VILLE, ARKANSAS, AS FOLLOWS: <br /> Section 1: That the following described lands shall be and are hereby re- <br /> zoned from Residential R-2 to Commerical C-2: <br /> A tract of land surveyed as part of the SW-1, of the SW-1, of Section 16, <br /> Township 13 North, Range 6 West, described thus: A part of Block One <br /> of the Bates Addition to the City of Batesville described as: Lot 1 <br /> and a 25 foot strip adjoining Lot 1 to the South, such strip being 25 <br /> feet off the North edge of Lot 6 and 25 feet off the East 2 of Lot 5. <br /> This tract is more particularly described as follows: Beginning at <br /> the intersection of the West line of Allen Street with the South line <br /> of Harrison Street, running Southerly along the West line of Allen <br /> Street 175 feet to a point, thence Westerly and parallel with Harrison <br /> Street 105 feet to a point, thence Northerly and parallel with Allen <br /> Street 25 feet to a point, thence Westerly and parallel with Harrison <br /> Street 35 feet to a point, thence Northerly and parallel with Allen <br /> Street 150 feet along the line between Lots 1 and 2 to a point on the <br /> South line of Harrison Street, thence Easterly along the South line <br /> of Harrison Street 140 feet to the point of beginning, containing <br /> 0.54 acres, more or less. <br /> Section 2: A copy of this Ordinance shall be filed by the City Clerk of <br /> the City of Batesville, Arkansas, in the office of the Recorder of Deeds of <br /> • this County and recorded in Deed Record Books of Independence County. <br /> Section 3: That the City Clerk shall cause the official zoning map of the <br /> City of Batesville, Arkansas, to note the change effected hereby. <br /> Section 4: That all Ordinances or parts of Ordinances in conflict herewith <br /> are hereby repealed. <br /> PASSED and adopted this Z +L day of August, 1986. <br /> • M <br /> ATTEST: <br /> 1m Shirrell , M "yor <br /> ; <br /> ' Larry Willi ms, City Clerk� <br />
