AN ORDINANCE REZONING CERTAIN PROPERTY IN THE CITY OF BATESVILLE,
ARKANSAS, LYING IN THE MAXFIELD THIRD EASTERN ADDITION TO THE CITY
OF BATESVILLE, IN INDEPENDENCE COUNTY, ARKANSAS.
WHEREAS, the City Planning Commission of the City of Batesville, Arkan-
sas, has recommended to the Batesville City Council that the following des-
cribed lands lying in Independence County, Arkansas, be rezoned from resi-
dential to commercial property; and
WHEREAS, after due notices as required by law, the Council has heard
all persons desiring to be heard on the question and has determined that the
property' s best use is commercial and that the property should be rezoned
under the classification of C-3; that other property owners in the area will
not be adversely affected by the rezoning and that the general public interest
• and welfare will not be adversely affected by said rezoning.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Batesville, Arkansas:
SECTION I : That the lands described herein shall be rezoned under the
classification C-3:
Lot Fourteen (14) of Block Forty Two (42) of Maxfield ' s
Third Eastern Addition to the City of Batesville, Arkansas.
SECTION II : A copy of the ordinance duly filed by the City Clerk shall
be filed in the Office of the Recorder of the county and recorded in the deed
records of Independence County.
SECTION III : It is hereby determined that the passage of this ordinance
is necessary for the preservation and protection of the public health, welfare,
and safety and, therefore, an emergency is declared to exist and this ordin-
ance shall be effective upon passage.
