ORDINANCE NO. An Ordinance rezoning certain property lying in School Addition to the City of Batesville , Independence County , Arkansas . WHEREAS, the City Planning Commission of the City of Batesville , Arkansas , has conducted a public hearing on the petition of Farm Bureau Insurance Company, Lion Inns , Inc. , Samuel Tisby Finley Estate and Ermyle Phillips for the rezoning of certain property lying in Batesville , Independence County , Arkansas , and the City Planning Commission has recommended to the Batesville City Council that the following described lands lying in Independence • County , Arkansas , be rezoned from Residential R-2 to Commercial C-2 : Lots 6 , 7 and 8 , Block 19 and Lots 9 and 10 , Block 51 , School Addition to the City of Batesville , Independence County , Arkansas ; WHEREAS, after due notices as required by law, the Planning Commission has heard all persons desiring to be heard on the questions and has determined that the property ' s best use is for commercial community district property and that the property should be rezoned under the classification Commercial C-2 . That other property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will not be adversely • affected by said rezoning . NOW, THEREFORE , BE IT ORDAINED by the City Council of the City of Batesville , Arkansas : (1 ) That the following described lands lying in ' Batesville , Independence County , Arkansas shall be rezoned under the classification Commercial C-2: i Lots 6 , 7 and 8 , Block 19 and Lots 9 and 10 , Block 51 , School Addition to the City of Batesville , Independence County , Arkansas . • ( 2 ) A copy of the ordinance duly filed by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County.
