A RESOLUTION ACCEPTING A SURVEY AS THE ACTUAL
(W STREET RIGHT-OF-WAY OF PORTER STREET BETWEEN
22ND STREET AND 23 AND STREET AND ALSO LOCATED BETWEEN
BLOCK 19 AND BLOCK 20 OF MAXFIELD 2ND EASTERN ADDITION TO
THE CITY OF BATESVILLE
RESOLUTION NO. . * * *
WHEREAS, the City Council of the City of Batesville has
directed that a survey be made for the purpose of determining the
location of the street right-of-way of Porter Street located
between 22nd Street and 23. Street in the City of Batesville and
between Blocks 19 and 20 of Maxfield's 2nd Eastern Addition to
the City of Batesville, Arkansas and;
WHEREAS, David L. Carpenter has caused a survey to be made
of that street right-of-way and prepared a plat of said surveyed
(W right-of-way on June 26, 1989 and;
WHEREAS, the City Council of the City of Batesville desires
to accept the June 26, 1989 as the true right-of-way of the
portion of Porter Street described hereinabove, now;
BE IT THEREFORE RESOLVED that the survey performed by David
L. Carpenter and plated on June 26, 1989, a copy of which is
attached hereto and incorporated herein by reference, is accepted
as the true right-of-way boundary for that portion of Porter
Street described here, and the Clerk of the City of Batesville is
directed to file a certified copy of this resolution along with
the plat attached hereto with the Circuit Clerk and Recorder of
AP
(W Independence County, Arkansas, and also to spread this resolution
across the records of the City of Batesville.

RE-USE PLAN
AID GRANT #790-00552
AUGUST 1985
AMENDED AUGUST 1989
PURPOSE OF AMENDMENT
The City of Batesville Re-Use Plan for AIDC Grant Number
790-00552 requires an amendment for the following reasons:
1. A loan of $225.000 was made to Omega Containers
Batesville. Inc.. to be repaid over ten years at 6%.
After two payments. the company ceased operation and
defaulted on the loan.
2. New Federal regulations state that recaptured funds
received after the grant closing date are no longer
bound by the requirements of Title I of the Community &
Housing Development Act of 1974. as amended.
The Re-Use Plan therefore no longer presents a useable plan for
the use of the repayments. This amendment provides the
mechanism to utilize the reduced amount of funds that are
available.
