WHEREAS , the City of Batesville, Arkansas has control of
Lock and Dam #1 located at Batesville, Arkansas and owns both
parcels of land adjoining said dam and,
WHEREAS, while said dam has many beneficial uses , including,
its potential use for the production of electricity, as an item
of interest for tourists , recreation for the citizens of
Batesville and a favorite place for sportsmen to fish, said
! dam has been dangerous for its entire existence of over 80 years
to those who are not careful and has been the cause of the loss
of many lives and,

WHEREAS, the Batesville City Council , while having no legal
duty to stop the negligent from being harmed at said dam,
recognize a moral duty to call attention to the potential danger
at the dam while not obstructing its use for the beneficial

purposes set out above.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BATESVILLE, ARKANSAS AS FOLLOWS:
'± Section 1 : That the City Council of the City of Batesville,
Arkansas hereby directs the City Street Department to place
appropriate signs on both sides of the dam warning the public
of the dam' s potential danger and warning them to use caution
while using the dam.
Section 2: That the City Council of the City of Batesville,
I Arkansas requests that the Mayor appoint a committee to study
what steps, if any, can be taken to make the dam sight more
safe for public use, without denying access to the dam or
interfering with its current uses and to have said committee
to report back to the city council within 30 days of the date
of appointment.
