'23 -9 -- 1 A RESOLUTION ESTABLISHING AN EXTENSION OF HARRISON STREET IN THE CITY OF BATESVILLE AND ESTABLISHING A SEWER EASEMENT ACROSS PART OF THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER AND THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER, SECTION 15 , TOWNSHIP 13 NORTH, RANGE 6 WEST WHEREAS, the City of Batesville is the owner of the land upon which the White-Rodgers plant is located in the City of Batesville , Arkansas , and has leased said land to Emerson Electric Company under a lease agreement dated January 27 , 1961; and WHEREAS , the property involved was encumbered in a certain Trust Indenture dated February 1 , 1961, between the City of Batesville and the National Bank of Commerce of Pine Bluff , Arkansas ; and WHEREAS , Emerson Electric desires to sell certain property owned by it lying immediately North and adjacent to the property upon which the White-Rodgers plant is located; and WHEREAS, it is necessary for the purpose of providing access and a sewer easement to the property being sold that an extension of Harrison Street be made from the point where it intersects with Bryant Street and that an easement for the purpose of laying and maintaining a sewer line is also necessary; and WHEREAS , the National Bank of Commerce has issued its release deed as to the tracts of land involved so that said pro- perty is no longer encumbered; IT IS, THEREFORE, RESOLVED : 1. That the following described property owned by the City of Batesville , Arkansas , is hereby established as a public street and is to be a portion of Harrison Street : A tract of land being part of the SW4 of the NE4 and part of the NW4 of the SE4 of Section 15 , Township 13 North, Range 6 West of the Fifth Principal Meridian, in the City of Batesville , Independence County, Arkansas , being more particu- larly described as follows : Beginning at a concrete monument at the SW corner of the SE4 of said Section 15 ; thence N 00°52148" W along the line between the E2 and the W2 of said Section 15 a distance of 2679. 20 feet to the point of beginning; thence continuing along said 2-section line N 00'52148" W a distance, of 47 . 28 feet ; thence N 88° 47 ' 45 " E a distance of 121 . 79 feet to a point on a 175 . 00 foot radius curve concave to the north; thence along the arc of said curve the chord for which being S 67"37 ' 18" W a distance of 130. 90 feet to the point of beginning , containing 0. 09 acres , more or less . 2 . That a sewer easement is hereby established as a public sewer easement in favor of the Utilities Commission of the City of Batesville described as follows : Part of the Northwest Quarter of Southeast Quarter and the Southwest Quarter of Northeast Quarter of Section 15 , Township 13 North, Range 6 West , described as follows : Five feet on each side of a line described as follows : Begin 2726. 48 feet North and 830. 48 feet East of the Southwest Corner of the SE4 of Section 15 , Township 13 North, Range 6 West at the West side of a drainage draw; thence South- westerly along the North and West side of said drainage draw to an existing sanitary sewer manhole on the North side of Arkansas Highway #69 , said manhole being 2076. 83 feet North and 49. 99 feet West of the Southwest Corner of the SE4 of Section 15 , Township 13 North, Range 6 West . 3. That upon completion of the street in accordance with the laws , rules and regulations of the City of Batesville , - 2 - �w Arkansas , the said street shall be accepted by the City of Batesville as a city street . We fully agree and consent to the approval and grant of these easements to aid in the development of a 20 acre track adjacent to the leased property.
