HomeMy WebLinkAbout1983-10-01-R r i RESOLUTION NO. 3 3 A RESOLUTION FIXING A DAY FOR A PUBLIC HEARING ON THE PETITION OF JOHN NORMAN HARKEY AND MALCOM MOORE AND BILL WALMSLEY AND JOHN BELEW AND ROBERT L. SLAUGHTER! AND MARY SLAUGHTER TO CLOSE AND VACATE THAT PART OF REYNOLDS STREET ABUTTING LOTS 5, 6, 7 AND 8 IN BLOCK 11 OF FITZHUGH PARK ADDITION AS WELL AS THAT PORTION OF REYNOLDS STREET ABUTTING LOTS 1, 2 AND 3 OF BLOCK 14 OF THE FITZHUGH PARK ADDITION TO THE CITY OF BATESVILLE, ARKANSAS, DIRECTING THE CITY CLERK. TO GIVE PUBLIC NOTICE OF SAID MEETING BY PUBLICATION AND FOR OTHER PURPOSES. WHEREAS, John Norman Harkey and Malcom Moore and Bill Walmsley and John ljBelew and Robert L. Slaughter and Mary Slaughter have filed a petition to close and vacate that part of Reynolds Street abutting Lots 5, 6, 7 and 8 in Block 11 of Fitzhugh Park Addition as well as that portion of Reynolds Street abutting Lots 1, 2 and 3 of Block 14 of Fitzhugh Park Addition to the City of Batesville, Arkansas; and WHEREAS, a public hearing must be had upon said petition as required by law; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS: 1. That the City Council shall hold a public hearing upon the petition of John Norman Harkey and Malcom Moore and Bill Walmsley and John Belew and Robert I L. Slaughter and Mary Slaughter to close and vacate the above described portion of Reynolds Street, said hearing to be held on the 15th day of November, 1983, at 7:00 P. M. at City Hall in the City of Batesville, Arkansas. 2. That the City Clerk is hereby directed to give notice of such meeting by publication once a week for two (2) consecutive weeks in the Batesville Daily Guard, a newspaper published in Independence County and having a general circulation in the City of Batesville. Slaughter and Mary Slaughter , is wife , and for their petition to close and vacate that part of eynolds Street abutting Lots 5 , 6 , 7 and 8 in Block 11 of Fitzhugh ark Addition as well as that portion of Reynolds Street abutting ots 1 , 2 and 3 of Block 14 of the Fitzhugh Park Addition to the ity of Batesville , Arkansas , being all of that portion of Reynolds treet lying between property currently owned by the Batesville ounty Club on the East and the intersection of Reynolds Street and 1st Street on the West and the petitioners state as follows : ( 1 ) That the petitioners , John Norman Harkey , Malcom Moore , Bill Walmsley , and John Belew , are the owners of Lots 5 , 6 , 7 and of Block 11 of the Fitzhugh Park Addition to the City of atesville , Arkansas , which lots are adjacent to , and North of , he street which petitioners propose to close . ( 2 ) That the petitioners , Robert L . Slaughter and Mary laughter , his wife , are the owners of Lots 1 , 2 and 3 of Block 14 f the Fitzhugh Park Addition to the City of Batesville , Arkansas , hich lots are adjacent to , and South of, the street which the etitioners propose to close . ( 3) That portion of Reynolds Street described in the introductory paragraph herein , has never been officially opened or aved and has not been actually used by the general public for more han the last five ( 5) years . (4) This is the first application filed for the closing of his portion of this street . ( 5) The petitioners will pay the cost of public notice and or the conduct of the public hearing . (6 ) That the portion of Reynolds Street described above and he subject of this petition has no beneficial use and is of no leneficial use to any person or to the city and should be closed . ( 7 ) That the city dead ends on the East with the Batesville ountry Club property which is currently being used , and has been used for many years , as a golf course and the Batesville Country lub does not desire that the street ever be opened . (8) That the property owners who would be affected by this reet closing have all joined in this petition and by their f I signatures hereto , hereby consent to said closing . �r (9 ) The closing of this street will not result in any hardship to any other parties or property owners , will not prejudic the Ultimate Planning Program of the City of Batesville , and the change would be in the best interest of the petitioners , the public and the City of Batesville .
